The Evolution of the Right to Liberty and Security of Person

آزادي و امنيت شخصي پس‌از حق حيات در شمار دغدغه‌هاي خطير انسان قرار مي‌گيرند. اهميت اين دو، موجب شناسايي حق آزادي و امنيت شخصي در اسناد بين‌المللي و منطقه‌اي حقوق بشر گرديده است. حق آزادي و امنيت شخصي از قديمي‌ترين و بنيادي‌ترين حق‌هاي بشري است كه در حوزه عدالت كيفري در زمره مباحث بسيار مهم قرار دارد. تلفيق حق آزادي شخصي و حق امنيت شخصي در اسناد حقوق بشري در قالب حق آزادي و امنيت شخصي نمود يافته است كه بررسي هر اين حق‌ها از ديدگاه كميته حقوق بشر و سازوكار اروپايي حقوق بشر نقش بسزايي در شناسايي حدود و ثغور حق آزادي و امنيت شخصي دارد. در اين مقاله، گستره مفهومي و حوزه شمول حق آزادي شخصي و حق امنيت شخصي مورد بررسي قرار گرفته و فراخور نياز به آراي كميته حقوق بشر و ديوان اروپايي حقوق بشر مستند گرديده و در پايان نيز به حق آزادي و امنيت شخصي در قانون اساسي جمهوري اسلامي ايران اشاره شده است.
