Weapons of Mass Destruction (WMD) and juridical-legal foundations for Prohibition of Using Them

بررسي اخلاقي، فقهي و حقوقي استفاده از سلاح‌هاي كشتار جمعي بر دو عنصر موضوعي و حكمي استوار است. در نوشتار حاضر تلاش گرديده است با توجه به مصاديق سلاح‌هاي كشتار جمعي، ملاك‌هاي موثر در حكم از قبيل حجم خسارت، نوع خسارت و قصد ايراد خسارت، بررسي و پس از آن با توجه قواعد مربوط به جنگ و جهاد و همچنين قواعد در جنگ و جهاد، وضعيت كشتار غيرنظاميان، به‌عنوان يك اصل و استثنايات وارده بر آن، بررسي شود. با توجه به اين دو امر، حكم استفاده از سلاح‌هاي كشتار جمعي مورد پژوهش قرار گرفته است. همچنين در حقوق اسلامي از آنجايي كه مبناي حكم، اراده تشريعي حكيمانه است، تلاش گرديده ملاك‌هاي مطرح در سلاح‌هاي كشتار جمعي با ادله فقهي و آرا فقيهان تحليل و حكم مسيله، استنباط شود.

Moral, juridical, and legal study of using weapons of mass destruction is based on two factual and judgmental issues. In the present writing, the author has tried to study factors influencing judgment such as extent of damages, type of damage, and intent to cause damage while taking into account instances of weapons of mass destruction. Then, while considering rules concerning war and jihad as well as rules which should be at work in war and jihad, the situation of slaughter of civilians has been, as a principle and its exceptions, discussed. Based on the two above points, the rule concerning weapons of mass destruction has been studied. Also, in the Islamic Law, since rule is based on the wisely legislative will, attempts have been made to analyze standards concerning weapons of mass destruction based on juridical proofs and opinions of jurists and the rule concerning this issue is inferred.
