رويكردهاي تفسير قانون اساسي؛ با نگاهي به نظريات شوراي نگهبان

Approaches to Constitutional Interpretation; with Regard to the Guardian Council’s Decisions

هر قاعده‌ي حقوقي در مقام اجرا نيازمند تفسير است، اين در حالي است كه قواعد به دلايلي چون اجمال و ابهام تاب تفاسير گوناگوني دارند. قانون اساسي نيز از اين اصل كلي مستثنا نيست، بلكه به‌سبب كليت، عموميت و كلان‌نگري و صعوبت نسبي اصلاح و بازنگري در آن، در مواردي تاب تفاسير بيشتري نسبت به ساير قوانين دارد. به‌سبب اينكه هر مرجعي براي نظارت بر اجراي قانون به‌ناچار آن را تفسير مي‌كند، در بيشتر نظام‌هاي سياسي دنيا نظارت بر اجراي قانون اساسي و تفسير آن به مرجعي خاص سپرده شده است؛ البته ماهيت مراجع تفسير قانون بر رويكردها و روش‌هايي كه اين مراجع براي تفسير قانون پي مي‌گيرند، نيز موثر است. در اين مقاله رويكردها و روش‌هاي تفسيري بررسي مي‌شود و از اين رهگذر مي‌توان تناسب هريك از اين رويكردها را با نظام‌هاي حقوقي مختلف ارزيابي كرد. در اين چارچوب، تحليل علمي و عيني نظريات شوراي نگهبان به‌عنوان متولي تفسير قانون اساسي در نظام حقوقي ايران نيز بهتر صورت خواهد گرفت.

The interpretation of law is prerequisite to implementing the law. Though, the rules, because of reasons such as brevity and ambiguity endures different interpretations. The constitution was not excluded thereto rather because of its generality and relatively difficult of revision process it is more capable of different interpretations. Since, each institution that monitors the implementation of the law will inevitably interpret it, in majority of the worldʹs political systems, monitoring of implementing, and interpretation of the constitution has been entrusted to certain body. Obviously, the nature of Interpreting body has some effects on the approaches and methods of interpretation. The purpose of this Article is to evaluate approaches and methods of interpretation. It can facilitate analyzing of fitness of each approach with any legal system, particularly the decisions of the Guardian Council as responsible authority for interpretation of the constitution in Iranian legal system.
