موضوع نظام حقوقي حاكم بر اجراي انتخابات به‌عنوان يك ساز و كار پيش‌بيني شده در قوانين اساسي، قوانين موضوعه و عرف‌هاي اساسي كشورهاي مختلف براي برگزاري يك انتخابات دقيق و سالم مورد اشاره قرار گرفته‌ است. اهميت و نقشي كه نظام مديريت اجرايي انتخابات در برگزاري يك انتخابات مدبرانه ايفا مي‌كند در نسبت مستقيمي با سلامت، شفافيت و صحّت جريان انتخابات قرار مي‌گيرد. در رويه عملي كشورها، تاكنون سه الگوي مستقل، دولتي و مختلط يا تركيبي براي نهاد مديريت انتخابات به رسميت شناخته شده است و از اين زاويه مي‌توان به طبقه‌بندي كشورهايي كه از اين الگوها تبعيت مي‌كنند، پرداخت. در واقع هدف اساسي از ايجاد نهادهاي انتخابات بر مبناي الگوهاي مذكور، تضمين حداكثري صيانت از آراي شهروندان و در نهايت برگزاري يك انتخابات عادلانه است. اگرچه با توجه به برخي شاخص‌ها مي‌توان مديريت اجرايي انتخابات را به چند الگو تقسيم كرد، اما در نهايت نمي‌توان با قطعيت ادعا كرد كه فرايند برگزاري انتخابات در چند كشور با يك الگو، به‌صورت يكسان اجرا مي‌گردد؛ بدين معنا كه نوع مدل نهاد مديريت انتخابات به‌طور قطعي نمي‌تواند مبيّن نوع فرايند همسان برگزاري انتخابات در كشورها ‌باشد. مقاله حاضر به بررسي حقوقي نظام‌هاي سه گانه مديريت اجرايي انتخابات در دنيا اشاره داشته، با برشمردن اصول حاكم بر عملكرد نهاد مجري انتخابات، به بررسي، تحليل و ارايه پيشنهاد درخصوص نظام اجرايي انتخابات در ايران مي‌پردازد.

The legal system governing the administration of elections as a mechanism has been mentioned at the constitutions, statute law and the fundamental customs of the different countries managing accurate and fair election. The significance and rule of the election administration system holding an advised election, has a direct ratio with healthy, clarity and accuracy of the election progress. In the practical praxis of countries, the independent, governmental and mixed models have been formally recognized; as countries following this model can be classified from this viewpoint. In fact, according to the given models, the basic purpose of making electoral institutions is the maximum guaranty of the protection of citizensʹ votes, and finally, performing a fair election. Although, based on some indicators, the executive management can be divided into several models, it is not possible to decisively assert that the process of implementation of the election in some countries with similar model hold equally; in other words, the model type of the institution of election administration cannot conclusively indicate the implementation of similar process of election of countries. This article tries to legally examine the Triple Systems Executive Management (TSEM) of election in the world and mentioning the Principles of ruling the activity of election institutions. Finally, some propositions regarding the administration of elections in Iran are offered.
