The Nature of Intellectual Property Right and its Place in Property Law

نقش غير قابل انكار حقوق مالكيت فكري در تحولات صنعتي و تجاري، موجب شده اين موضوعات وارد ادبيات حقوقي شود. با ورود حقوق مالكيت فكري به ادبيات حقوقي، حجم قابل توجهي از قوانين ومقررات، به آن اختصاص يافت.حقوقدانان نيز براي تشريح و تبيين آن همت گماشتند. در اين ميان، به ماهيت اين حقوق و جايگاه آن در حقوق اموال مكتر پرداخته شده است.مقاله حاضر، با درك اين واقعيت كه تشريح و تبيين مسايل حقوق مالكيت فكري، مستلزم شناخت ماهيت و جايگاه آن در حقوق مالي است،مي‌كوشد ابتدا از طريق بازتعريف اين حقوق، بررسي ايجاد و زوال آن، بيان موضوع اين حقوق، تحليل اوصاف و آثار، و تشريح رابطه بين پديدآورنده و پديده فكري، ماهيت حقوق مالكيت فكري و جايگاه آن در حقوق اموال را تبيين كند و پس از آن تا حد ممكن، قواعد حاكم بر اموال مادي را بر اين اموال- كه از جنس ديگري هستند- اعمال مي‌نمايد، بدون اينكه در اين كار اغراق كند يا از واقعيت ها دور شود.

The undeniable role of intellectual property right in commercial and industrial changes caused these subjects enter into the legal literature. Their entrance to legal literature, in addition to the allocation of considerable number of laws and regulations, provides a context for the explanation of these subjects by jurists. However, the nature of these rights and theirs positions in property law has not yet been regarded. Having regarded the fact that the explanation of problems of intellectual property right requires analysis of nature of intellectual property right and their positions in property law, the present paper, redefining these rights, reviewing their creation and wane, description of object of these rights, explanation of features and effects, reviewing the relation between its creator and intellectual phenomenon intends to explain the nature of intellectual property right and their positions in property law . Moreover, it strives to apply the governing rules of physical property to these properties which are from a different substance without exaggerating and or digressing from facts.
