The relationship between power and Shari’a in the Prophet’s behavior

فعاليت‏ها و اقدامات سياسي پيامبر صلي‏الله‏عليه‏و‏آله در مدينه، گونه‏اي خاص از اعمال قدرت را در عرصه زندگي عمومي مردم نمايان مي‏سازد. از سوي ديگر، پيامبر صلي‏الله‏عليه‏و‏آله پس از دريافت شريعت، به ابلاغ آن پرداخته، احكام و آموزه‏هاي آن را در ميان مردم اجرا كرده است. ملاحظه اين دو واقعيت در زندگي و سيره وي، پرسش از نسبت اعمال قدرت وي با شريعت اسلام را به پرسشي اساسي تبديل مي‏كند. مناسبات قدرت و شريعت در سيره سياسي پيامبر صلي‏الله‏عليه‏و‏آله، دو سويه است: مناسبات قدرت با شريعت و مناسبات شريعت با قدرت. سرشت و ماهيت قدرت، اهداف قدرت، ساختار نظام سياسي و شيوه‏ها و ساز و كارهاي اعمال قدرت پيامبر صلي‏الله‏عليه‏و‏آله، مهم‏ترين عرصه‏هايي است كه در آنها قدرت با شريعت ارتباط برقرار مي‏كند. سرشت و ماهيت شريعت، اهداف شريعت و شيوه‏ها و ساز و كارهاي تحقق شريعت پيامبر صلي‏الله‏عليه‏و‏آله نيز مهم‏ترين عرصه‏هايي است كه در آنها شريعت با قدرت ارتباط برقرار مي‏سازد. بر اين اساس مناسبات مذكور، ارتباطي متقابل و دو سويه را به نمايش مي‏گذارد؛ هر چند كه به نظر مي‏رسد، قدرت در سيره سياسي پيامبر صلي‏الله‏عليه‏و‏آله تابعي از شريعت وي است. اين مقاله در دو بخش مناسبات قدرت و شريعت را مورد بررسي قرار مي‏دهد. در بخش نخست، مناسبات شريعت با قدرت و در نتيجه سرشت و ماهيت شريعت، اهداف آن و نيز ساز و كارهاي تحقق شريعت در پرتو قدرت وي مورد بررسي قرار مي‏گيرد. در بخش دوم مناسبات قدرت با شريعت مورد توجه قرار مي‏گيرد و تاثير پذيري سرشت و ماهيت قدرت،اهداف قدرت و ساز و كارهاي اعمال قدرت پيامبر صلي‏الله‏عليه‏و‏آله از شريعت اسلام بيان مي‏گردد. بررسي‏هاي مذكور ضمن نشان دادن تقدم شريعت بر قدرت در سيره سياسي پيامبر صلي‏الله‏عليه‏و‏آله، مناسبات و ارتباط دو سويه آنها را نيز نمايان مي‏سازد.

The Prophet’s political activities in Medina indicate a particular kind of power exercise in the public domain. On the other hand, after receiving Shari’a, he promulgated it and enforced the related verdicts and teachings among people. Realization of these two facts in his behavior turns the relationship between power exercise by him and Islamic Shari’a into a basic question. The relationship between power and Shari’a in the Prophet’s political behavior is bidirectional: the relationships between power and Shariʹa and the relationship between Shariʹa and the relationship between Shariʹa and power. The nature of power, the goals of power, the structure of political system, and the methods of power exercise are the most important domains in which power relates to Shariʹa. Thus, the above-mentioned relationships show a bidirectional relationship, though it seems that in the political behavior of the Prophet power is dependent on Shariʹa. The paper studies the relationship between power and Shariʹa in two parts. The first part studies the relationship between Shariʹa and power and, as a result, the nature of Shariʹa, its goals, and the mechanisms of the realization of Shariʹa in the light of power. The second part the relationship between power and Shariʹa and expresses the impressionability of the nature of power, the goals of power, the methods of power exercise by the Prophet. The study shows the priority of Shariʹa over power in the political behavior of the Prophet and the bidirectional relationship between them.
