The Validity of Future Contracts from the Perspective of Imamiah Jurisprudence

قراردادهاي آتيِ استاندارد نوعي از تعهد بر انجام بيع در آينده مي باشند كه در چارچوب هاي بورسي استاندارد شده اند. در اين قراردادها وجه التضميني از طرفين براي اطمينان از انجام تعهد خريد يا فروش در آينده گرفته مي شود كه طي ساز و كار هايي اين مبلغ در فرايند تسويه، بين حساب هاي طرفينِ قرارداد جا به جا مي شود. رواييِ استفاده از قراردادهاي آتي، به عنوان يك نهاد قراردادي نوظهور در گرو تاييد علم حقوق مي باشد. اين مهم به انجام نمي رسد مگر در توجه به بنيان فقه اماميه و قوانين موجود. روش انجام اين پژوهش از نوع كتابخانه اي مي باشد. در اين پژوهش با بررسي و پذيرش اصل آزادي قراردادي در فقه اماميه و حقوق موضوعه و هم چنين پاسخ به اشكالات مطرح شده در خصوص اين قراردادها از جمله قماري بودن، عدم قصد معامله، غرري بودن، اكل مال بالباطل و ... اين نتيجه به دست آمد كه روايي اين نوع از قراردادها مورد تاييد فقه اماميه و حقوق موضوعه مي باشد و استفاده از آنها با تعريفي كه در ابتدا آمد مواجه با منع قانوني و شرعي نمي باشد.

Standard futures contract is a kind of fulfillment requirements of pledge in future which hase been standardized according to the exchange frameworks. In such contracts, a financial bond is received- either sale or buying in future- for assurance of fulfillment of a mandate which is transferred upon on predefined procedures between the two accounts of parties of a contract. The validity of usage of future contracts as a new contractual entity is to be confirmed by law specialists. This will notbe achieved unless in due attention to premises of Imamiah jurisprudence and the existing rules. The methodology is library study. In the present survey, after investigation and acceptance of the principle of contractual freedom in Imamiah Sect, associated subjects and answering to some discussed issues on these contracts- having gambling characteristics, lack of transaction intention, un-decidability, exploiting non-authorized properties, etc.- it was concluded that such contracts are confirmed by Imamiah Sect and associated premises. So, using such contracts is not legally and Shari ah Prohibited.
