تاملي بر برخي از بايسته‌هاي تصميم‌گيري اداري شخصي در پرتو آراي شعب ديوان عدالت اداري

Reflections on some Individual Administrative Decision-making Requirements in the light of Judgments of Administrative Justice Court Branches

با توجه به اصل حاكميت قانون، مراجع اداري مكلف‌اند در چارچوب قوانين و مقررات تصميم‌گيري كنند. در قوانين و مقررات براي تصميم‌گيري مراجع اداري بايسته‌هايي در نظر گرفته شده است كه رعايت نكردن آنها، موجب نقض اين تصميمات خواهد شد. در نظام حقوقي ايران، ديوان عدالت اداري مرجع قضايي نظارت بر رعايت بايسته‌هاي مذكور توسط مراجع اداري است و نظارت قضايي بر تصميمات اداري شخصي، در صلاحيت شعب ديوان عدالت اداري قرار دارد. اين مقاله در پي پاسخ به اين پرسش است كه شعب ديوان عدالت اداري چه بايسته‌هايي را براي تصميم‌گيري اداري شخصي ضروري دانسته‌اند. همچنين سعي شده است با بررسي توصيفي- تحليلي آراي شعب ديوان عدالت اداري، به اين پرسش پاسخ داده شده و بايسته‌هايي كه شعب ديوان، در تصميم‌گيري‌هاي مراجع اداري، ضروري دانسته‌اند، استخراج شود. شعب ديوان عدالت اداري در راستاي انجام وظيفهي مذكور، در آراي صادره‌ي خود، بايسته‌هايي را كه مرجع اداري ملزم به رعايت آنها در تصميمات خود است، از جمله قانوني بودن، برابري و عدم تبعيض، مستند و مستدل بودن تصميمات اداري، مورد توجه قرار داده و تصميمات اداري را در صورت رعايت نكردن آنها نقض كرده‌اند.

According to the rule of law principle, administrative authorities should decide within the framework of the laws and regulations. In this framework, some requirements are considered for decision-making of administrative authorities so that non-compliance of them will lead to quash these decisions. In the legal system of Iran, the Administrative Justice Court is the judicial authority for supervising the compliance of the above requirements by administrative authorities and judicial review on individual administrative decisions is within the jurisdiction of the branches of the Administrative Justice Court. This article seeks to answer the question that what requirements are considered essential for individual administrative decision-making in the Administrative Justice Court branches. In this paper an attempt has been made to answer to this question through a descriptive-analytical study and to deduct the requirements deemed necessary in decision-makings of administrative authorities. In order to perform this task, the branches of the Administrative Justice Court in the judgments issued have regarded some requirements such as legality, equality and non-discrimination, being documented and well-reasoned, which the administrative authorities are obliged to abide them in their decisions and have quashed administrative decisions if they are not observed.
