تحليلي بر مفهوم نهادهاي زير نظر رهبري در نظام تقنيني ايران

An analysis on the concept of “institutions under the supervision of the leader” in the Iranian legislative system

«نهادهاي زير نظر رهبري» عبارتي است كه در بسياري از قوانين عادي به‌كار مي‌رود و عاملي براي لحاظ استثناياتي در قوانين است. تعريف و مصاديق اين عبارت ابهام دارد و اغلب تفسيري موسع از آن صورت مي‌گيرد. حال آنكه شايسته است اولاً ملاك مشخصي در تعريف اين نهادها اتخاذ شود تا مصاديق آن قابل احصا باشد و ثانياً مستثنا شدن اين نهادها از شمول برخي قوانين، سازوكار مشخصي داشته باشد. ملاك مجلس شوراي اسلامي در تعيين اين نهادها «دستگاه‌هاي جز اجرايي» است كه به‌نظر مي‌رسد هيچ لزومي به استثنا كردن آن‌ها از قوانين، به استناد زير نظر رهبري بودن وجود ندارد. ضمن اينكه ايرادات شوراي نگهبان، دليل اتخاذ اين رويكرد توسط قانونگذار عادي است. اما ملاكي كه براي تعيين اين نهادها مورد تاكيد نوشتار پيش روست، اين است كه نهادي كه تمام تصميمات آن به تاييد رهبري برسد، نهادي زير نظر رهبري است كه براساس اين معيار، مستثنا شدن نهادهاي زير نظر رهبري از برخي قوانين توجيه‌پذير خواهد بود.

Institutions under the supervision of the leader, is a phrase that is used in many laws and has been a cause for considering some exclusions in laws. Definition and examples of this phrase is ambiguous and often it is interpreted extensively. However, it is appropriate, firstly, to adopt specific criteria to define these institutions so as to its examples become countable and secondly excluding these institutions from the inclusion of some laws have a specific mechanism. The criterion of Majlis in determining these institutions is “executive institution” that seems there is no need to exclude them from the laws, due to being under the supervision of the leader. While the challenges of the Guardian Council, has been the cause of adoption of this approach by the ordinary legislator. The criterion that this article emphasize in determining these institutions, is that an institution that all its decisions is affirmed by the Leader, is named Institutions under the supervision of the leader. Based on this criterion, excluding these Institutions From some laws would be justifiable.
