Global Rights of Therapeutic Human Simulation Struggle in the realm of Bio- Medical international law

زمينه و هدف: شبيه‌سازي درماني يا تحقيقاتي نوعي شبيه‌سازي انسان است كه هدف از آن باز توليد يك فرد نيست، بلكه به دست آوردن سلول‌هاي بنيادين براي درمان بيماري‌ها و صدمات فردي است كه شبيه‌سازي مي‌شود. در اين مقاله به مفهوم شبيه‌سازي درماني، ديدگاه انديشمندان به اين موضوع و ارتباط آن با كرامت انساني پرداخته مي‌شود. روش تحقيق: مطالعه حاضر به روش توصيفي تحليلي و با استفاده از منابع كتابخانه‌اي نوشته شده است. يافته‌ها: ايرادات متعددي به شبيه‌سازي درماني واردشده كه از جمله آن‌ها عدم كارايي موثر، ملازمه آن با سقط‌جنين و مغايرت با كرامت بشري است. اين در حالي است كه اولاً بسياري از انتقادهايي كه متوجه شبيه‌سازي يا همسانه سازي شده، در بسياري از موارد از عدم درك صحيح ابعاد علمي اين موضوع ناشي شده كه به نوبه خود ناشي از تازگي و پيچيدگي شبيه‌سازي است. ثانياً با لحاظ برخي گزارها و اسناد حقوقي بين‌المللي و نيز برخي قواعد فقهي مسلم نظير قاعده «تلازم حكم عقل و شرع» و «ضرورت و مصلحت»، به نظر مي‌رسد شبيه‌سازي درماني انسان بر وجه اطلاق مغاير مفهوم كرامت بشري نيست، و نيز نظر به فوايد ارزشمند آن كه مورد تاييد دانش پزشكي نيز مي‌باشد، مي‌تواند حداقل به طور مضيق و در برخي از مراحل حيات جنين از توجيه فقهي نيز برخوردار باشد. نتيجه‌گيري: شبيه‌سازي درماني انسان با كرامت انساني مغايرت ندارد و حداقل در برخي مراحل حيات جنين از توجيه علمي و فقهي برخوردار است.

Context and objective: Research or therapeutic human simulation is a kind of simulation that does not seek to reproduce a person and simulates stem cells to treat diseases and injuries. This paper deals with concept of therapeutic simulation, scholars view on the subject and its relation with dignity. Methodology: This research is descriptive- analytic and library based. Findings: There are several objections to therapeutic simulation, such as, lack of efficiency, its association with abortion and its contradiction with human dignity. The first of many criticisms that have been directed to simulation comes from the fact that there is a lack of understanding of scientific aspects of the subject which is caused by its complexity and novelty. With reference to international legal reports and documents as well as clear religious rules, such as, requiring wisdom and sharia and necessity and expedience, it seems that there is no contradiction between therapeutic simulation and human dignity and also to consider its benefits for medical school in some cases it has juridical justification in some stages of fetus life. Results: There is no contradiction between therapeutic human simulation and human dignity and it has juridical justification in some stages of fetus life.
