مفهوم و مباني كنترل نامشهود توسط پليس

نهاد پليس براي برقراري نظم و پيشگيري از وقوع جرم، اقدامات متعددي انجام مي دهد. يكي از اقدامات مهم نهاد پليس در اين زمينه، كنترل نامشهود اعضاي جامعه مي باشد. كنترل نامشهود، به روش هاي مختلفي صورت مي گيرد كه شايع ترين مصاديق آن در اين مقاله معرفي و مطالعه شده است. سوالاتي كه در اين تحقيق به آن پاسخ داده شده عبارت است از: 1- آيا كنترل نامشهود پليس در نظام حقوقي ايران داراي مفهومي مستقل مي باشد؟ 2- آيا كنترل نامشهود داراي مبناي توجيه كننده مي باشد؟ مهمترين اقدامات به عمل آمده در اين تحقيق، معرفي مصاديق نهاد كنترل نامشهود و تبيين نحوه كاركرد آن مصاديق در زمينه ارايه مفهومي مستقل از كنترل نامشهود مي باشد. ديگر اقدامات انجام داده شده در اين تحقيق، معرفي مباني و اصول نهاد كنترل نامشهود مي باشد. با تحقيقي كه در ارتباط با موضوع مقاله صورت گرفت، تا به حال مفهوم مستقلي از نهاد كنترل نامشهود ارايه نشده است. به عنوان مثال تا به حال قانوني كه در آن نهاد نظارتي پليس مخفي و يا نظارت سايبري، تعريف و تبيين شود، موردي مشاهده نشده است. همچنين كنترل نامشهود خود داراي مبناي متعددي مي باشد كه مي توان با استناد به آن اِعمال نهاد كنترل نامشهود را توجيه نمود.

Context and objective: Police have taken various measures to establish order and prevent crime. One of important actions in this regards invisible way of policing society members. Invisible policing is carried out in different ways. The most common ways are presented and examined in this article. The research questions include: 1. Does invisible policing have a specific concept in Iran’s legal system? 2. Does indirect policing have a justifying foundation? Methodology: The present method is descriptive-analytic and has an applied objective. The article data have been gathered in documentative-library way. Findings: The most important actions taken in this study are presenting the cases of invisible policing and explaining the functions of those cases in the area specific conceptual presentation of invisible policing. Other actions taken in this study have been introduced and show the principles of invisible policing. Results: In this research conducted in connections with the topic, no specific concept has been presented yet. For example, the rule to define and explain hidden police control instruction and cyber control has not been existent. Also, invisible policing has various foundations on the basis of which invisible policing can be justified.
