Responsibility of States for Expulsion of Aliens, with Special Attention to the Case Law of Iran-United States Claims Tribunal

حقوق بين الملل اختيارات وسيعي در موضوع ورود و خروج بيگانگان به دولت ها اعطا كرده است. دولت ها تقريباً از صلاحديد مطلق براي ورود خارجيان برخوردارند. اما به محض اينكه در قلمرو آن ها حضور يابند، حقوق بين الملل انتظار دارد كه دولت سرزميني (ميزبان) قواعد خاصي را نسبت به بيگانگان رعايت كند. مقاله ي حاضر جنبه ي عدم رعايت قواعد مربوط به مسيوليت دولت مطابق حقوق بين الملل، قواعد حاكم بر اخراج بيگانگان و پيامدهاي حقوقي ناشي از آن را مورد بررسي قرار مي دهد. در سال هاي اخير، مساله ي اخراج بيگانگان ارتباط تنگاتنگي با قواعد حاكم بر حقوق بشر پيدا كرده است. در دهه‌ ي 1980 ديوان داوري دعاوي ايران و ايالات متحده اين فرصت را يافت كه به مساله ي اخراج در سطح وسيعي بپردازد، رويه ي قضايي ديوان نيز مورد توجه ويژه قرار گرفته است. ديوان مزبور به قواعد حقوقي و همچنين آثار ناشي از اخراج اتباع خارجي پرداخته و مطالب مهمي در اين زمينه بيان كرده و موضع حقوق بين الملل درباره ي اخراج بيگانگان را روشن تر نموده است.

International law allocates large discretion for States on the issue of permission to enter and deportation of aliens. States enjoy almost absolute discretion for the entry of foreigners. But once they are on their territory, international law expects the territorial State to observe certain rules vis-à-vis the alien. The present Article deals with the latter aspect of the rules of state responsibility under international law, the rules governing the expulsion of aliens and its legal consequences. In recent years the question of expulsion of aliens has gained close affiliation with rules governing human rights. Finally, due to the extensive treatment of the subject by the Iran-U.S. Claims Tribunal in 1980s, the case law of the Tribunal is also paid special attention. The Tribunal dealt with the legal rules on this subject, as well as the financial consequences of the expulsion of aliens. Since in practice there is no possibility of restitution of the expelled alien, the main consequence is of course the financial one.
