A Comparative Study of the Foundation and Nature of the Civil Liability of a State

حاكمان به مرور متوجه شدند كه رسيدن به قدرت، جز با حمايت مردم مقدور نبوده و بقاي حكومت نيز در گرو پشتيباني مردم مي‌باشد؛ و حمايت مردم نيز حاصل نمي‌شود، مگر اينكه حاكمان خود را پاسخگو بدانند. از اين تاريخ به بعد فرضيه مسيوليت جاي مصونيت مطلق را گرفت و لذا امروزه سخن از گستره و ابعاد مسيوليت مدني دولت و از چگونگي آن است نه از اصل آن؛ و اينكه آيا دولت نسبت به تمام اعمال و اقدامات زيان‌آفرين خود بايد پذيراي مسيوليت باشد يا صرفاً در قبال آن دسته از اقداماتي كه به خاطر نقص فني و تشكيلات اداري عايد مردم گردد؟ با اين حال مبنا و ماهيت مسيوليت مدني دولت همچنان در هاله‌اي از ابهام است. در اين مقاله پس از بيان عوامل پيدايش مسيوليت مدني دولت به آن خواهيم پرداخت.

With the passage of time, rulers came to realize that coming into power, is not possible without the people’s support and a state cannot survive without popular support and people’s support cannot be obtained unless the rulers hold themselves accountable to the people. It was then that the theory of responsibility replaced the theory of absolute immunity. Therefore, today we speak of the scope and different aspects of civil liability and how it has to be addressed not it’s necessity or whether the state is responsible for all its harmful actions or it is only responsible for losses resulting from technical problems and administrative procedures. In this article, after explaining what let to the emergence of the civil responsibility of states, we will discuss it.
