بهره‌گيري از شيون معصوم در استنباط مسايل فقه سياسي

Taking Advantage of the missions of Infallibles Concerning the Deduction of Political Jurisprudence

ابلاغ پيام الهي يكي از مهم‌ترين شيون پيامبر9 و امام7است. ولي اين شان تنها شان آنان نيست بلكه معصومان شيون ديگري نظير شان تفريع، ولايت و ارشاد داشته‌اند. در اين مقاله تلاش شده است تا در حدّ ظرفيت يك مقاله به برخي از ديگر شيون معصومان بپردازد و با تتبع در روايات فقه سياسي برخي از رواياتي كه احتمال دارد از ساير شيون معصوم صادر شده باشد، بيان شود. با اين بيان اگر روايتي از شان عادي معصوم صادر شده باشد از قلمرو فقه خارج خواهد بود و اين يكي از پيامدهاي استفاده از اين شيون خواهد بود. پيامد ديگر اين توجه اين است كه ممكن است برخي از احكامي كه در روايات آمده تطبيقات و مصاديق حكم فقهي باشد نه خود حكم فقهي كه جاودانه و جهان‌شمول است. پيامد ديگر اين توجه حل تعارض ميان روايات در عرصه فقه سياسي است. در اين مقاله هفت شان معصوم ذكر شده است رواياتي كه از شان تبليغ، تفسير و تشريع صادر شده است قابل استناد در فقه سياسي است، ولي رواياتي كه از شيون ديگر صادر شده است، علي‌القاعده قابل استناد در فقه سياسي نخواهد بود.

The propagation of divine message is considered as one of the most significant missions of prophet and Imam. Besides, they have been given the other assignments such as ramification, Wilayat as well as guidance. In this article, it has been endeavored to investigate some of the other duties of infallibles and to state the narrations issued on the other duties of infallibles through studying the narrations of political jurisprudence. If a narration issued on the ordinary mission of infallible, it is out of the domain of jurisprudence and this is one of the consequences of exploiting these missions, the other outcome would be the possibility of presence of some decrees within the narrations which are the adjustments and referents of the jurisprudential decree not the jurisprudential decree itself regarded as an eternal and worldwide issue. The other result is allied to the termination of incongruity among narrations in the domain of political jurisprudence. In this article, it has been declared seven missions of infallibles, together with the narrations issued concerning the propagation and interpretation of religion while being documentable within the political jurisprudence; conversely, the narrations issued from the other missions would not basically meet this property.
