قاعده «لزوم معاشرت به معروف» در روابط زن و شوهر

The Jurisprudential Rule of Necessity of Behaving Reasonably in Marital Relationship

اين مقاله به واكاوي قاعده كمتر شناخته شده «لزوم معاشرت به معروف در روابط زن و شوهر» مي‌پردازد. به موجب اين قاعده، رفتار متقابل زن و شوهر بايد هماهنگ با عرف روزآمد جامعه مسلمانان باشد. اين به معناي آن است كه افزون بر آموزه هاي ديني مستفاد از كتاب و سنت، آن دسته از عرف هاي عقلاني كه در متون ديني صريحاً يا ضمناً از آن ها نهي نشده باشد، مي تواند و بايد هماهنگ با آموزه‌هاي ديني نقش تعيين-كننده اي در ترسيم نظام حقوق خانواده ايفا نمايد؛ حتي اگر اين عرف ها نوپيدا باشند. بدين سان «معروف» مفهومي عرفي است كه مصاديق آن بر حسب زمان و مكان و نيز درجه تمدن و فرهنگ جامعه اسلامي كه زوجين در آن زندگي ميكنند، مي تواند متفاوت باشد. مقاله به روش تحليلي و با استناد به قرآن مجيد، سنت پيامبر?(ص) و امامان معصوم?(ع) و موارد استناد فقيهان به لزوم معاشرت به معروف، براي توسعه آن به يك قاعده فقهي الزامي استدلال نموده و با توجه به عموم ادله نشان داده است كه قاعده مي تواند در همه قلمروهاي روابط خانوادگي از جمله: مديريت خانواده، روابط زناشويي زوجين، چند و چون نفقه، سكناي زوجين و تصميم درباره كم و كيف فرزندآوري مورد توجه قرار گيرد.

This article analyzes a lesser-known rule in the Islamic jurisprudence entitled “The necessity of behaving reasonably in marital relationship”. According to the rule, the mutual legal relationship between wife and husband must be based on the current rational custom of Islamic society. In other words, in addition to what holy Qur’an says, the manner of the Prophet Mohammad, and infallible Imams, new rational customs can and must play decisive role in determining the frame-work of Islamic family law, as far as they have not been rejected explicitly or implicitly in Islamic teachings. In this way the examples of customary and reasonable behavior may vary from time to time, place to place and from one culture and civilization to another. Due to the generality of the evidence supporting the rule from the Holy Qur’an, narrations (ahadith) and jurists’ reliance upon the ruling in different cases, the article tries to strengthen and develop the rule and shed light on its implementation in areas like management of the family, sexual relationship, financial issues, residency and decision about reproduction
