تحليلي بر اختلاف ديدگاه علماي موافق و مخالف مشروطه

Discrepancy in Beliefs among the Scholars of Constitutionalism

بررسي اختلاف ديدگاه علماي موافق و مخالف مشروطه و مفاهيم مرتبط با آن موضوع اصلي نوشتار حاضر است. نويسنده با استفاده از آموزه «اختلاف ديدگاه‌ها» تلاش كرده است، چگونگي اختلاف ديدگاههاي علماي مشروطه را توضيح دهد. در اين نوشته اختلاف ديدگاه علما نسبت به مفهوم حكومت مشروطه و مفاهيم پيراموني آن همچون قانون، آزادي، و برابري مورد توجه قرار گرفته است. از ديدگاه حاكم بر نوشتار حاضر، اختلاف در موضعگيري علماي اين دوران، قبل از هر چيز، ريشه در اختلاف برداشت آنان از مشروطه و مفاهيم مرتبط با آن دارد. بدون توجه به اين اختلاف ديدگاه نميتوان به تحليل اختلاف موضعگيري آنان در ماجراي مشروطيت پرداخت.

The study of scholars’ view- pros and cons- concerning the constitutionalism and the concepts related to it would be considered the main issue of the present article. Taking advantage of the instruction of “Discrepancy in Beliefs”, the author has endeavored to clarify the quiddity of discrepancy among the scholars of constitutionalism period. In this writing, it has been considered the divergence among the scholars towards the concept of constitutionalism and the issues around it such as law, freedom, and justice. According to the article, difference in taking position of the scholars in this period, before everything, refers to their different views towards constitutionalism and the concepts connected to that. Without regarding their incongruity in beliefs, it is not possible to analyze their different positions in regard with constitutionalism.
