بررسي قاعده «يُغتفر في الدوام ما لايُغتفر في الابتداء» در فقه اسلامي

A study of the rule ‘Unforgivable in continuity (survival, sustainability) is not unforgivable in the beginning’

در فقه اسلامی با عبارت‌هایی از جمله «یغتفر فی الدوام (البقاء، الاستدامه) ما لایغتفر فی الابتداء» مواجه می‌شویم كه از سیاق آن این‌گونه برمی‌آید كه این عبارت، نزد فقها به‌عنوان قاعده‌ای مشهور و مقبول مورد لحاظ واقع شده است. لكن پس از بررسی ردپای این عبارت در كتب فقه و قواعد فقه به نظر می‌رسد در خصوص خاستگاه اصلی این عبارت و حتی استقلال آن، وحدت نظری وجود ندارد. برخی آن را ذیل قواعد «الدفع اقوی من الرفع» یا «التابع تابع» و یا «المانع طاری» ذكر كرده‌اند و برخی نیز از آن در مبحثی مستقل نام برده‌اند. در انتها پس از تحلیل و بررسی گفته‌ها در خصوص این عبارت و بیان ادله، به نظر می‌رسد می‌توان به‌عنوان نتیجه، آن را نه ذیل قواعد سه‌گانه مذكور بلكه به‌عنوان قاعده‌ای مستقل لحاظ كرد مبنی بر اینكه آنچه ابتدا به آن حرام و ممنوع است در ادامه، دوام و بقای آن حرام و ممنوع نیست.

In Islamic jurisprudence we face phrases such as ‘Unforgivable in continuity (survival, sustainability) is not unforgivable in the beginning’ whose context suggest that this is considered by scholars as a known and accepted rule. But, after examining the traces of the phrase in the books of jurisprudence and rules of Islamic jurisprudence, there seems to be no consensus as regards the authentic origin of this expression and even its independence. Some have mentioned this phrase in relation to the rules ‘Rejection is stronger than removal’ or ‘The follower follows’ or ‘The impediment is created, and some have called it as an independent subject. Finally, after analyzing and examining the statements about this phrase and providing some arguments, it seems that as a result we can consider it not as following the three rules, but as an independent rule; on the basis that what is prohibited and forbidden in the beginning, in continuity its sustainability and survival shall not be prohibited.
