بررسي برخي حقوق غيرمالي زوجين در نكاح منقطع

A Study on Some NonFinancial Rights of Couples in Discontinuous Matrimony

هرگاه عقدي به طور صحيح واقع شود، حقوق و تعهداتي معين را براي طرفين آن به بار مي‌آورد. در عقود شخصي مانند نكاح برخي از اين آثار حقوق و تعهدات غيرمالي است. نكاح منقطع نيز از اين امر مستثني نيست و با انعقاد آن حقوقي بر عهده زوجين قرار مي‌گيرد كه حق فسخ به واسطه عيوب زوج و زوجه و هم‌چنين حق بذل مدت، از جمله آن‌هاست. اما قانون‌گذار ايران و به تبع آن حقوقدانان از تبيين دقيق، صريح و روشن اين امر، غفلت نموده‌اند. به نظر مي‌رسد با توجه به گسترش اين نوع از نكاح نكاح منقطع و آثار آن، نمايندگان مجلس بايد در پي تدوين مواد قانوني صريح و به دور از ابهام، در جهت بيان آثار حاكم بر اين عقد، كه از جمله آن‌ها حقوق غيرمالي زوجين است، باشند تا افراد با آگاهي كامل نسبت به احكام و آثار اين عقد، به انعقاد آن اقدام نمايند. پاسخي كه به عنوان يك امر كلي مي‌توان بيان نمود، اين است كه با جاري ساختن قاعده «لاضرر ولاضرار في‌الاسلام» و قاعده «نفي عسر و حرج»، مي‌توان موارد فسخ نكاح دايم را به نكاح منقطع نيز سرايت داد. هم‌چنين با توجه به قواعد فقهي، مي‌توان تحت شرايطي به زوجه نيز حق بذل مدت را اعطا نمود. كه در خصوص هر يك از اين حقوق، سوالات و ابهامات قانوني و اختلاف آرا وجود دارد. در اين مقاله تلاش شده است تا به تفصيل به هر يك از اين موارد پرداخته شود.

If a marriage occurs correctly, it will raise some given rights and commitments for couples. In personal marriage such as matrimony, some of these rights are non-financial and commitments. Discontinuous matrimony is not excluded from this issue and by approving it, couple undertake some rights that dissolution right through man and womanʹs fault and also duration munificence right is their responsibility. However, Iranʹs lawmaker and hereafter, lawyers have neglected of exact, and explicit explaining.It seems that with regard to this kind of matrimonyʹs extension in modern society and available legal spaces for discontinuous matrimony and its results, council agents should persist in compiling explicit and clear legal provisions in order to express the results of this marriage that among them is non-financial rights of couple, until people can conclude sentences and this marriage results with full understanding. An answer which can be argued in general is that we can also transmit continual marriage dissolution instances to discontinuous matrimony based on the fat that there is no forced loss in Islam as a rile. Also, according to jurisprudence rules, duration munificence right can be granted to couple under some conditions. Particularly for each right, there are questions, legal ambiguities and different opinions. This article aims to address these points in details.
