The Necessity of Personality File Formation in Juvenile Delinquent Trial

نظام دادرسي نوين، با گذار از آموزه‌هاي كلاسيك به كلي متحول گرديده و تحت تاثير جريان هاي فكري روشنگرانه، سعي در احياي نوعي سيستم دادرسي كاربردي مدرن دارد كه مرتكب جرم را محور مطالعات نظري و ميداني قرار داده و با ابداع روش-هاي علمي، مبادرت به ارزيابي و آزمايش شخصيت بزهكاران به ويژه اطفال بنمايد. اين تحول فكري را بايد مولود تلاش‌هاي مكاتب بشري در توسعه سياست جنايي كاربردي و رويكرد عدالت خواهانه و انسان محور دانست. از اين رو، لزوم تشكيل پرونده شخصيت براي وصول به هدف فردي كردن واكنش‌هاي اجتماعي و تعيين ضمانت اجراي مناسب با اوصاف شخصيتي بزهكاران، ذهن انديشمندان و مصلحان چرخه عدالت كيفري را به خود معطوف داشته و موجب گشته است كه قانون گذاران با درك واقعيات موجود، آزمايش علمي شخصيت بزهكاران را به ‌عنوان يك الزام حقوقي در قوانين دادرسي، پيش بيني و نتايج آن را در سرنوشت كيفري مجرمين تصريح نمايند. مقاله حاضر، با درك اهميت اين موضوع و در شرايطي كه نظام دادرسي اطفال ايران، در آستانه آزموني ديگر قرار گرفته، به بررسي وضعيت حقوقي و قانوني جايگاه پرونده شخصيت در نظام قضايي اطفال ايران پرداخته و جهات مثبت و منفي آن را با لحاظ لايحه پيشنهادي جديد رسيدگي به جرايم اطفال و نوجوانان، به محك نقد و بررسي درآورده است. نتايج حاصل از اين تحقيق، حاكي است كه: شناسايي شخصيت اطفال بزهكار با هدف فردي كردن واكنش اجتماعي، امري ضروري و اجتناب‌ناپذير است؛ تشكيل پرونده شخصيت بايد به يك الزام حقوقي با ضمانت اجرايي قوي مبدل گردد؛ سياست جنايي كاربردي بايد جايگزين سياست جنايي ذهني و غيرعملي گردد؛ نظام دادرسي ايران، با تشكيل پرونده شخصيت به مفهوم علمي آن بيگانه و با وضعيت ايده‌آل فاصله زيادي دارد؛ لايحه پيشنهادي جديد با وصف اشاره غيرمستقيم به ضرورت تشكيل پرونده شخصيت، فاقد انسجام و صراحت لازم و كافي در اين زمينه است.

The modern trial system has utterly changed through passing classic learnings. In effect of explicatory intellectuals, the new system is trying to revive a kind of modern practical trial system in which both the committer of a crime is the pivot subject of theoretical and practical studies and the personality of the delinquent especially juveniles is tested by scientific methods. This intellectual transformation must be regarded as the result of humanist schools efforts to develop practical criminal policy based on fairness and human oriented approach. Thus, the necessity of making personality file in order to individualizing social reactions and determining a sanction appropriate to character of specified delinquents both have become the focus of research in criminal justice system and have made the legislators to incorporate the scientific test of delinquent’s character as a legal obligation in trial rules, and to explain it’s results in delinquents criminal life. While Iran’s juvenile trial system is under another test, this research studies legal situation of personality file in Iran’s juvenile judicial system by focusing on the new suggested bill of proceeding juvenile delinquency and its positive and negative points. Some highlights of this research are as follows:1. It is essential and inevitable to recognize the character of juvenile delinquents with the aim of individualizing social reactions. 2. Forming personality file must be conversed into a legal obligation with a strong sanction. 3. Practical criminal policy should be the substitution of Theoretical and subjective criminal policy. 4. Iran’s trial system does not recognize the forming personality file in its scientific concept and is far away from the ideal situation. 5. The new proposal bill lacks cohesion and clearness in this way; although it has done an indirect reference to the necessity of forming personality file.
