نظام انتخاباتي كارآمد مجلس شوراي اسلامي در پرتو نظام‌هاي انتخاباتي

The Favorable Elective System of Islamic Consultative Assembly relying on the Elective systems

نظام انتخاباتي شيوه و سازوكاري براي تبديل آراي مردم به كرسي‌هاي نمايندگي است. گزينش نوع نظام انتخاباتي تأثير بسزايي در تحقق انتخابات واقعي و اصيل، صيانت از حقوق انتخاباتي و تشكيل پارلمان كارآمد دارد. نظام انتخاباتي مجلس زماني كارآمد خواهد بود كه متناسب با ماهيت و ساختار نظام سياسي كشور، اصول و قواعد انتخابات رقابتي و منصفانه و توزيع عادلانه و منصفانه كرسي‌هاي نمايندگي بين رقبا باشد. اين مقاله ضمن مطالعه اصول و قواعد حاكم بر گزينش نظام انتخاباتي و تشريح و ارزيابي انواع نظام‌هاي انتخاباتي، در پي پاسخ‌دهي به اين پرسش است كه ـ با در نظر گرفتن ماهيت نظام سياسي جمهوري اسلامي ايران ـ كدام نظام انتخاباتي مي‌تواند اصل نمايندگي، مجلس كارآمد، مشاركت حداكثري عموم، حقوق كانديداها، احزاب و مردم و انتخابات منصفانه و رقابتي را محقق كند. با درك اين امر كه قانون اساسي بر اصول برابري، آزادي، عدم تبعيض، حق مشاركت سياسي عام، اصل نمايندگي ملي، استقلال و وحدت تأكيد كرده است، اين مقاله نظام انتخاباتيِ تركيبيِ «اكثريتي ـ تناسبي» را به عنوان نظامي مطلوب و كارآمد براي تحقق اين ارزش‌ها و غايات، موجه‌سازي و پيشنهاد مي‌كند.

The elective system is regarded as a strategy to change the votes of people to the representative chairs. Deciding on this kind of elective system is highly effective in favor of the realization of real and righteous elections as well as the conservation of the elective rights along with the development of efficient parliament. The elective system of assembly will be efficient provided that it is consistent with the nature and the structure of political system of country as well as the principles and rules of competitive and fair election with the purpose of a fair distribution of representative chairs among the competitors. Investigating the principles and rules dominant on choosing the elective system along with the explanation and evaluation of all kinds of elective systems, this article is to answer this question: considering the nature of political system of country, which elective system is able to fulfill the principle of representativeness, the efficient assembly, the largest cooperation of people, the rights of candidates, the fair and competitive elections? Understanding this issue related to the constitution’s emphasis on equality, freedom, no discrimination, right of public political cooperation, the principles of national representative, independence and unity of the country, the elective system with the combination of majority and proportional in order to cover the values and declared fundamental objectives as a favorable and qualified pattern of elective system of Islamic consultative assembly is justified and recommended.
