the nature of superiority

اين پژوهش به بررسي ماهيت قوّاميت مرد در فقه شيعه مي‌پردازد و تلاش مي‌كند به اين پرسش پاسخ دهد كه «آيا ماهيت قوّاميتْ كارپردازي و عامل اجرايي بودن است يا نوعي ولايت؟». براي پاسخ به اين پرسش در ابتدا دو آيه‌ «قوّامون» و «درجه» مورد بررسي قرار مي‌گيرند؛ سپس، رواياتي كه رابطه زن و شوهر و احكام اين رابطه را بيان مي‌كنند تحليل سندي و دلالي مي‌گردند و در پايان، آثار قوّاميت در ابواب مختلف فقهي مرور مي‌گردد. اين بررسي‌ها نشان مي‌دهد كه ماهيت قوّاميت نوعي از ولايت فقهي است كه در آن نظر شوهر در برخي تصرفات همسر دخالت دارد.

This research investigates the quality of superiority of men in the jurisprudence of Shi’ah and tries to answer to this question whether the quality of superiority is executive or a kind of guardianship. To answer to this question, the first two verses of “superiors (qavvamun)” and “rank (darajeh)” are investigated. Then the narrations stating the relationship between husband and wife and the regulations related to it are analyzed on the basis of document and cause. Finally, the works of superiority in the diverse jurisprudential issues are reviewed. These studies clarify that the quality of superiority is a kind of jurisprudential guardianship in which the idea of husband will be significant in some wife’s affairs.
