The Mutuality of Teleologism and utility-based Deontologism in Punishment Justification

توجيه كيفر در فلسفه اخلاق معاصر تحت سيطره و نفوذ دو جريان ديرپا در ساحت اخلاق هنجاري، يعني غايت گرايي و وظيفه گرايي است. وظيفه گرايي به نفس عمل مي نگرد و درستي و نادرستي اَعمال را فارغ از پيامد هاي احتمالي شان، داوري كرده و در صدور احكام هنجاري نظر به غايت ندارد. توجيه كيفر در اين سُنت بر پايه تقدم حق بر خير، ايده استحقاق و با نگاه به گذشته و عنصر مكافات صورت مي گيرد. در مقابل، غايت گرايي بر نتيجه استوار است و گزاره هاي تكليفي را با عنايت به پيامد رفتار آدمي تجويز مي كند. غايت گرايي در خوانش فايده گرايش با تقليل حُسن و قُبح اَعمال به فايده مرتّب بر آنها در توجيه مجازات نظر به آينده دارد. مقاله حاضر بر آن است كه با اتخاذ رويكردي تجويزي در توجيه كيفر و اولويت بخشيدن به اخلاق وظيفه گرا، فايده گرايي را به مثابه يك هدف فرعي براي نظام عدالت كيفري در نظر گيرد. اين ديدگاه عدالت را هدف اصلي و محوري حقوق كيفري مي داند و مواردي چون پيشگيري، اصلاح و درمان را هدف ثانوي مي پندارد.

Punishment justification in contemporary ethics philosophy is under supremacy and influence of two old courses in normative ethics construction, i.e. deotologism and teleologism. Teleologism regards action itself and arbitrates concerning validity and invalidity of actions out of their possible consequences and does not regard deontology in normative issuing of orders. Punishment justification in this respect is based on priority right to good, idea of deserve, backward-looking and retribution element .In contrast, deotologism is based on result and prescribes obligatory actions with regard to human behavior consequences and its utility. Deontologism in the utilitarian interpretation, by reducing good and evil of actions with pleasure and suffrage in punishment justification regards the future. The present article is seeking to regard utilitarianism as a subsidiary aim for criminal justice system by adopting a prescribed approach in punishment justification and priority to ethics. This approach regards justice as the main aim of criminal law and views prevention, reformation and treatment as the secondary aim.
