The Relationship Between Morality and Legal Statements in Commerce in Light of Nahj-al-Balagha

اخلاق يكي از منابع علم حقوق به شمار مي‌رود. اخلاق نيروي پر تواني است كه كار ايجاد قواعد حقوقي را رهبري مي‌كند. اما با اين وجود اخلاق و حقوق داراي مفهوم و قلمرو يكسان نيست. حقوق وظيفه برقراري نظم و عدالت را در جامعه به عهده دارد و اين مهم محقق نمي‌شود مگر با الهام گرفتن از قواعد و اصول اخلاقي كه از منابع وحي و آموزه‌هاي ديني سرچشمه گرفته است كه اين همان انديشه اقتصادي اسلام و اميرالمومنين(ع) است. يكي از اين منابع آموزه‌هاي ديني نهج‌البلاغه است كه هر چند نهج‌البلاغه همه گفته‌هايي نيست كه از حضرت به ياد مانده، اما مراجعه به نهج‌البلاغه و دقت در آن، ما را تا حدي با سيره تربيتي حضرت در مورد مسايل اقتصادي آشنا ساخته است. سقوط يك جامعه در نگاه حضرت به‌خاطر سقوط هنجارهاي اخلاقي و پيشرفت آن جامعه نيز به‌خاطر همين هنجارها مي‌باشد. در اين مقاله بعد از تعريف اخلاق، قلمرو آن با حقوق و ارتباط بين آن‌ها و اصول اخلاقي حاكم بر معاملات از ديدگاه حضرت علي(ع) مورد بررسي قرار گرفته است. يافته‌هاي اين مقاله نشان داد اجراي دقيق اصول اخلاقي ذكر شده توسط ايمه اطهار(ع) و آموزه‌هاي ديني نظم اجتماعي و عدالت را در جامعه برقرار خواهد كرد.

Morality is one of the sources of Law and has strong power that lead to the production of legal rules. However, morality and law don’t share a similar content and domain. Law duty to maintain public order and justice in society And this cannot be achieved except by inspiration from moral rules and ethical principles that derived from sources of revelation and religious teachings these are Islam’s and Imam Ali’s economic thoughts. Nahj-al-Balagha is one of the sources of religious teachings, although Nahj-al-Balagha isn’t the whole sayings of Imam Ali that remains from him, but Carefully read and referred to the Nahj-al-Balagha largely makes us familiar with Imam Ali’s training on economic issues. In His mind, the destruction of a society is due to the destruction of moral norms, and the development of a society is due to the same norms. In this article, In the beginning morality and law and their relationship defined and then ethical principles governing the commerce from the perspective of Imam Ali (PBUH) is investigated. The results of this study indicate that, the strict implementation of ethical principles that stated by Infallible Imams (peace be upon them) and religious teachings will establish social regularity and justice in society.
