مفهوم و شرايط تحقق اثر مشترك ادبي و هنري در نظام حقوقي ايران و آمريكا

The Concept and Realization of the Joint Works in Iran and America Law

آثار ادبي و هنري مشترك كه امروزه در جوامع علمي، فرهنگي و هنري به‌ويژه در مجامع دانشگاهي رشد فزاينده داشته است، اهميت دارد. مسئله مفهوم و شرايط تحقق اثر مشترك در نظام‌هاي حقوقي مختلف وجوه اشتراك و افتراق دارد. اين نوشتار با مطالعه تطبيقي مسئله مزبور در نظام‌هاي حقوقي ايران و ايالات متحده آمريكا به اين نتيجه دست­ يافته است كه اثر مشترك در حقوق ايران صرفاً ناظر به آثاري است كه سهم پديدآورندگان مختلف در اثر ­تفكيك‌نشدني است. حال آنكه در حقوق آمريكا، در موردي كه سهم پديدآورندگان انفكاك‌شدني بوده، ولي به يكديگر وابسته‌اند، نيز تحقق اثر مشترك ممكن است. همين امر موجب تفاوت بنيادين در مصاديق اثر مشترك در دو نظام حقوقي است. در هر حال، در هر دو نظام حقوقي قصد مشاركت در زمان خلق اثر و تحقق عملي مشاركت از شرايط تحقق اثر مشترك است. البته در حقوق آمريكا قصد «شناخته‌شدن به‌عنوان پديدآورنده مشترك» نيز علاوه بر قصد مشاركت، لازم است.

Literary and artistic joint works are prepared by two or more authors. It's Importance, have increasingly grown today, particularly in academic areas. One of the issues related to these works is the problem of identifying the concept and realization of the joint works in the different legal systems which has similarities and differences. This research is a comparative study in mentioned issue in Iran and America law. According to researches which have been done in the context of joint work, in Iranian law, the joint work simply refers to works that contains inseparable parts of the various authors. But, in United States legal system even authors share interdependent parts, joint work can become exist. However, in both legal system, authors must intent to participate in making the work while the work is making. In American law, the intention of being a coauthor is also needed.
