A New View on the Quranic Exegesis of the Wifes Disobedience

ديدگاه مفسران و فقهاي عظام درباره مفهوم نشوز زوجه در آيه 34 سوره نساء و مسئله تنبيه بدني به دو نظريه كلي بازمي‌گردد؛ گروهي نشوز زوجه را امتناع از ايفاي وظيفه زناشويي و گروه ديگري آن را به مفهوم عام امتناع از ايفاي وظايف همسري تفسير كرده‌اند. بر اساس اين نظريه‌ها، شوهر مي‌تواند پس از پنددهي و دوري‌گزيني، همسرش را به روش تنبيه بدني از نشوز بازدارد. موضوع نوشتار كنوني، نقد تفاسير مذكور و طرح تفسير جديدي است كه بر اساس آن مقصود از نشوز، خيانت كمتر از زنا به‌وسيله زوجه است. در نتيجه اعطاي مجوز تنبيه بدني به شوهر، به عدم تمكين يا تخلف‌هاي جزئي در زندگي مشترك مربوط نمي‌شود و به آلوده‌دامني زن و تقصير زن در حق‌الله ناظر است.

The view of exegetes and the great Islamic jurisprudents on the meaning of wifes disobedience in the Quran 4: 34 and the matter of physical punishment returns to two general theories: wifes disobedience is interpreted by a group of exegetes and Islamic jurisprudents as the wifes denial of sexual duties, while it has been interpreted, in its general meaning, by another group as the wifes denial of marital duties. Based on these theories the husband, after giving advice and keeping away from his wife, can prevent her from disobedience through physical punishment. The present text aims at criticizing the abovementioned interpretations and presenting a new exegesis based on which disobedience is meant the wifes betray lower than adultery. As a result, allowing the husband to physically punish her wife is not related to the wifes disobedience or minor violations of marital rights, but it pertains to the womans disloyalty and violating Gods right.
