Examining the Foundations of the Democratic Validation of Constitutional Review

مشروعيت نهاد ناظر اساسي به اعتبار و جايگاه آن كمك كرده و تمامي اشخاص اعم از عمومي و خصوصي را به احتمال زياد قانع مي كند كه به تصميمات آن احترام بگذارند و همچنين بر كارامدي آن تاثيرگذار است. ازاين رو، اثبات مشروعيت نظارت اساسي امري سودمند و لازم است. با عنايت به مطالب مزبور، در مقاله ي حاضر اين سوال مطرح شده است كه با اينكه نهاد ناظر اساسي به صورت مستقيم منتخب مردم نيست، چگونه مي تواند مشروعيت دموكراتيك داشته باشد؟ فرض اين تحقيق بر آن است كه به رغم وضعيت مذكور، اين نهاد مي تواند مشروعيت دموكراتيك به صورت غيرمستقيم داشته باشد و براي اثبات مشروعيت نهاد ناظر اساسي، راهكارهاي علمي مشخصي وجود دارد. اصلاح دموكراسي، نگاه تاريخي به پيدايش نهاد ناظر اساسي، اهداف دموكراسي، احترام به حقوق اقليت و نفي استبداد اكثريت و عدم امكان مشروع سازي همه ي نهادهاي سياسي از طريق دموكراسي مستقيم، از مهم ترين عناصري است كه در اين مقاله بر آن ها به عنوان سازوكارهاي مشروعيت سازِ نهاد ناظر اساسي تاكيد شده است. به هر حال، اين مقاله درصدد رفع شبهه ي ناسازگاري دموكراسي با نظارت اساسي است.

The legitimacy of the Constitutional review authority contributes to its validation and status. This matter most likely convinces all the public and private persons to respect its decisions and also affects its efficacy. Therefore, it is not only useful but also essential to prove the legitimacy of Constitutional review. Accordingly, the question is that although this entity isn’t directly elected, how it can have legitimacy? The assumption of this article is that in spite of such status, the democratic legitimacy can be also produced indirectly and determinant scientific solutions are presented to prove such legitimacy. Reforming the democracy, a historical viewpoint toward the emergence of the Constitutional review entity, the goals of the democracy, respect for minority rights and denial of the tyranny of the majority, and the impossibility to legitimize all the political institutions through direct democracy are as the most important elements which are emphasized in this article as the legitimating mechanisms of the Constitutional review entity. By the way, this article seeks to solve the doubt of incompatibility of democracy with Constitutional review.
