Systematicity of Hegel’s Political Philosophy from its Methodical Perspective: Natural Law or Natural Rights

تفسير فلسفۀ سياسي هگل همواره مسئله‌ساز بوده است. در اين ميان تفسيري را مي‌توان بهتر دانست كه اين مسئله‌سازي را بر اساس محور اصلي‌ آن آشكار كند. به نظر مي‌رسد يكي از اساسي‌ترين تمايزها ميان سنت قدمايي قانون طبيعي و سنت مدرن حقوق طبيعي، از نوع انسان‌شناسي فلسفي آن‌ها ناشئ مي‌شود. در مورد فلسفه سياسي هگل نيز مي‌توان اين پرسش را تجديد كرد؛ اينكه «آيا فلسفۀ حق مستلزم نوعي انسان‌شناسي فلسفي است يا خير؟». آشكار است كه اين پرسشئ بنيادي و فراگير است؛ اما يكي از مقدمات طرح اين پرسش، بررسي نسبت فلسفه سياسي هگل با دو سنت كلي پيش از آن است. اين نوشته به تحليل اين نسبت از منظر نظام‌مندي فلسفۀ حقمي‌پردازد؛ و به دلايلي كه خواهد آمد اين نظام‌مندي را از نظر روش‌مندي مد نظر قرار مي‌دهد. نتيجۀ اين تحليل صرفاَ صورت‌بندي دقيق‌تر همان پرسش خواهد بود: آيا خودِ نظام‌مندي – يا روش‌مندي – فلسفۀ سياسي هگل مستلزم نوعي انسان‌شناسي فلسفي است؟

Hegel’s philosophy often gives way to handful of ambiguities. And particularly interpretation of Hegel’s political philosophy always is a problematic one. Assuming one of the fundamental differences between ancient tradition of natural law and modern tradition of natural rights is due to their philosophical anthropology, it is possible to ask this question again as regards Hegel’s political philosophy: “Does Philosophy of Right entails some kind of philosophical anthropology?” Although it is a general question, but examining the relation of Hegel’s political philosophy to two considerable earlier traditions is a necessary step. This paper deals with the analysis of this relationship from the point of view of systematicity of philosophy of rights; and as we will see this systematic aspect is seen from its methodical perspective. The result of this analysis is an exact formulation of the foregoing question: Does the systematic – or methodical – aspect of Hegel’s political philosophy entail some kind of philosophical anthropology?
