John Stuart Mill and the uniqueness Liberty-Limiting Principle

جان استوارت ميل، فيلسوف ليبرال مسلك بريتانيايي، در رساله اي درباره آزادي با تكيه بر مفهوم ضرر، در صدد ارائه اصل و معياري براي تحديد دامنه اقتدار و دايره دخالت دولت در حوزه خصوصي شهروندان و تعيين و تحديد مرز و محدوده آزادي هاي فردي برآمد كه امروزه با نام «اصل ضرر» شناخته مي‏شود. تلاش و تاملات ميل در اين راستا و اصل ابداعي او، هرچند در نظر بسياري تحسين و يا تلقلي به قبول شده است و از زمان طرح و تدوين، به عنوان يكي از اصول محوري ليبراليسم شناخته مي‏شود، ولي مدلول و محتواي اين اصل و انگاره همواره مناقشه برانگيز و آماج نقد و انتقادهاي اساسي بوده و حتي برخي هواداران ليبراليسم نيز با اذعان به كاستي ها و كم مايگي آن، در پي تجديدنظر و ارائه تقريرهايي تعديل يافته و منسجم از آن برآمده اند. در اين مقاله، پس از اشاره به پيش فرض هاي ميل در تدوين اصل ضرر، به تبيين، بررسي و نقد مبنا و مدعاي اصل ضرر و واكاوي جايگاه آن در سياق و ساختار نگرش ليبراليستي و سودگرايانه ميل پرداخته شده است.
