Conflict between International Court of Justice Votes and other International Courts

ديوان بين المللي دادگستري به عنوان ركن قضايي اصلي سازمان ملل متحد، جايگاه رفيعي در حقوق بين الملل به خود اختصاص داده است. به رغم آن كه، ساير دادگاه هاي بين المللي به طور كلي هماهنگ با ديوان مذكور گام برداشته اند، در برخي موارد، تصميماتي برخلاف رويه ي قضايي ديوان اتخاذ نموده اند؛ از آن جمله تصميمات صادره در قضاياي كارخانه ي كورزو، شركت هاي تجاري بلژيك در ديوان دائمي بين المللي دادگستري، قضاياي لوپزيدو، الادساني و در ديوان اروپايي حقوق بشر، قضيه ي فولمن و محموديان در ديوان دادگستري اروپا و قضيه ي تاديچ در ديوان بين المللي كيفري يوگسلاوي سابق است. اين نوشتار درصدد پاسخ به اين پرسش است كه در فرض تعارض اسناد بين المللي و آراء محاكم بين المللي، تصميمات كدام دادگاه مبناي استناد و عمل قرار مي گيرد. دادگاه هاي بين المللي و تنظيم گنندگان اسناد بين المللي، در موضوعات مورد اختلاف ميان دادگاه ها، به پذيرش يافته هاي ديوان بين المللي دادگستري گرايش داشته اند.

lnternational Court of Justice as the principal judicial organ of the United Nation allocated the very eminent place to itself. Although other International Courts are generally consistent with the Court, they rarely judge against of judicial precedents of the Hague Court. The Chorzow Factory case and The Societe Commerciale De Belgique in Permanent Court of International Justice, Loizidou case, Behrami & Saramati case, and AI - Adsani case in European Court of Human Rights, Hadadi case, Avello case, Devred case, Kadi case ,and Fulmen & Mahmoudian case in European Court of Justice ,and Tadic case in International Criminal Tribunal for the former Yugoslavia are examples on Conflict between International Court of Justice Judgments and other International Courts. In this regard, in case of conflict the question arises that Judgments of which court is observed in International Documents and Judgments of International Tribunals in cases of Conflict between International Courts? International Court and Regulators of International Documents Which always have considered valuable judicial decisions on the Sentencing and Codification, the dispute among international courts, have tended to accept the findings of the International Court of Justice.
