رابطه ميان حسن ظاهر و عدالت انسان از منظر فقه اماميه

The Relationship between Human’s Appropriateness of Appearance and his Justice in Shi’ite Jurisprudence

يكي از مسايل مورد بحث نزد فقهاي اماميه، نقش حسن ظاهر در كشف عدالت انسان است برخي بر آنند كه حسن ظاهر براي اثبات عدالت كافي است و نيازي به جستجو و تحقيق از حالات باطني فرد نم يباشد و برخي حسن ظاهر را كشف كنندۀ عدالت نمي دانند. در اين نوشتار ضمن بازخواني كلمات فقها و بررسي دلايل، اثبات شده كه دلايل كاشفيت حسن ظاهر از عدالت كه مشتمل بر چند روايت صحيح است، هم از نظر سند و هم از نظر دلالت تمام و هماهنگ با اعتبار عقلي است. اين در حالي است كه دلايل مخالفان تمام به نظر نمي رسد، د لالت روايات مورد استناد مخدوش و اصل مورد ادعا در اين مسأله جايگاهي ندارد، در نتيجه حسن ظاهر انسان براي اثبات عدالت وي كافي است، حسن ظاهري كه پس از دقت و مقداري بررسي به دست آيد به گونه اي كه فريبكار از غير فريبكار شناخته شود

The role of appropriateness of appearance in discovering human’s justice is one of the controversial issues among Shi’ite jurists. Some believe that human’s appropriateness appearance is sufficient for his justice and we needn’t search and survey about his interior attributes. Some of them believe that appropriateness of appearance does not reveal human’s justice. While reappraising the jurists words and studying the proofs, this paper has proved that the evidences dealing the appropriateness of appearance including some traditions are of reasonable authority and well documented. Whereas, the opponent’s proofs fail to be agreed upon, since designation of the tradition is not acceptable and the principle claimed is not valid. Therefore, one’s appropriateness of appearance is sufficient for proving justice. Appropriateness of appearance that is arrived at after some accuracy and survey, in some ways distinguishes deceitful from nondeceitful.
