ارائه قوانين مالكيت و بررسي راهكارهاي ابطال و اثبات مالكيت جهت كاهش آمار دعاويي در مراجع قضايي

Developing the property laws and evaluating the solutions for revocation and proof of property in order to reduce the number of actions brought in courts of justice

عدم آگاهي كافي از مفهوم مالكيت و نحوه برقراري آن عمده دعاوي مطروحه در محاكم قضايي را تحت عناوين ابطال مالكيت، اثبات مالكيت، خلع يد و غيره را به خود اختصاص داده است. تجربه و سابقه تاريخي دعاوي مالكيت نشان مي‌دهد كه مقررات و قوانين موجود در رويه قضايي حاكم بر دعاوي قادر به حل مشكل و كاهش آن نمي‌باشد. در اين تحقيق مفاهيم اصلي مالكيت ارائه شده و با بررسي مفهوم مالكيت در جوامع مختلف و نمونه موارد تجربي، هدف اصلي، آشنايي با فضا و مفهوم مالكيت و آثار مرتبط بر آن تا حتي‌الامكان آمار دعاويي در مراجع قضايي كاهش يابد، زيرا عدم آگاهي و عدم آشنايي با اين مفاهيم سبب وضع ورود پرونده‌هاي متعدد به محاكم و اطاله دادرسي مي‌باشد

Lack of sufficient awareness of the concept of property and how to establish this concept is among the major actions brought in the courts of justice under the names of revocation of property, proof of property, expropriation and so on. Experience and the historical background of property actions show that the existing rules and regulations of the judicial precedents of actions are not able to solve and reduce the problems. This study has presented the main concepts of property and experimental samples in various communities with the main goal of getting familiar with the concept of property and its relate effects and possibly reducing the number of actions brought in courts of justice, since lack of awareness of and familiarity with these concepts leads to multiple cases brought to courts and also results in the prolonged proceedings.
