با عمل تسليم، مبيع تحت كنترل و در اختيار خريدار قرار مي‌گيرد و مشاراليه قادر مي‌گردد تا حقوق مالكانه خود را بر آن اعمال كند. اين ماهيت مشترك در هر دو مورد نظام حقوقي مورد بررسي اين مقاله(حقوق ايران،حقوق آلمان)وجود دارد. از طرف ديگر انتقال مالكيت مبيع به خريدار كه هدف اصلي عقد بيع در همه نظام‌هاي حقوقي است، زماني‌ قابل تحقق است كه مبيع در وضعيتي قرار گرفته باشد كه اعمال حقوق مالكانه بر آن توسط خريدار ممكن‌ باشد. نظامهاي مختلف حقوقي در خصوص زمان انتقال مالكيت در عقد بيع، نظر واحدي ندارند و با توجه به نوع مورد معامله زمان انتقال متفاوت مي‌باشد. در مورد عين معين، كلي در معين و كلي في الذمه، نظام حقوقي اسلام زمان انتقال مالكيت را زمان انعقاد قرارداد مي‌داند. قانون مدني ايران نيز با اقتباس اين انديشه از فقه اماميه همين ديدگاه را انتخاب كرده است. تحقيق حاضر سعي در تبيين و بررسي جايگاه ضمان معاوضي در نظام حقوقي ايران با نگرشي در حقوق كشور آلمان دارد
