قتل از گناهان كبيره‌اي محسوب مي‌شود كه در فقه و قانون جزاي ايران مورد توجه قرار گرفته است. طرح دعواي قتل در دادگاه شرايطي چون عقل، بلوغ، رشد و جزميت دعوي دارد؛ همچنان كه اثبات آن نيازمند راه‌هايي خاص مثل شهادت، اقرار، علم قاضي و بينه است. در ميزان اشتراك و افتراق قانون مجازات اسلامي با فقه اماميه در خصوص شرايط دعوي و نيز انواع راه‌هاي اثبات آن ابهاماتي وجود دارد كه رفع آنها انجام پژوهشي در اين باره را مي طلبد. در اين تحقيق كه به روش توصيفي تحليلي صورت پذيرفته، با ذكر و بررسي ديدگاه‌ها و ادله فقها و مقايسه موارد مربوط به قتل در قانون جزايي با اقوال آنان، به دست آمده است كه مواد قانوني قانون مجازات اسلامي در شرايط دعوي قتل و راه‌هاي اثبات آن، در اجمال و تفصيل تفاوتهايي با متون فقهي دارد.
