The Role of Social Work in Protecting the Victimized and Delinquent Children

ورود مددكاران اجتماعي به نظام عدالت كيفري عمومي در بستر آموزه‌هاي جرم‌شناسي باليني و به منظور تحقق‌بخشي ايده اصلاح و درمان و بازپروري بزهكاران در زندان‌ها و مراكز بازپروري، آغاز گرديد و با پيگيري سياست‌هاي؛ قضازدايي، كيفرزدايي و حمايت از بزه‌ديدگان توسط نظام‌هاي مختلف، امروزه مددكاران در نهادهاي مربوط به حل و فصل اختلافات و صلح و سازش از قبيل ميانجيگري كيفري، در نظارت بر اجراي مجازات‌هاي اجتماعي و حمايت از بزه‌ديدگان خاص، در نقش‌هاي مختلفي ظاهر شده‌اند. در نظام عدالت كيفري اطفال نيز حضور مددكاران اجتماعي از سابقه‌اي طولاني برخوردار است. در هر سه حوزه؛ دادرسي ويژه اطفال و نوجوانان بزه‌كار و حمايت از اطفال و نوجوانان در معرض خطر و بزه‌ديده، مددكاران اجتماعي وظايف مختلفي را برعهده گرفته‌اند. نظام عدالت كيفري ايران به ويژه در سال‌هاي اخير از رهگذر لوايح قضايي تهيه شده، در حال حركت به سمتي است كه نقش‌ها و وظايف مختلفي را به مددكاران اجتماعي واگذار نمايد. به دليل وظايف مهم و حساس مددكاران اجتماعي در نظام عدالت كيفري اين گروه از متخصصان از يك نوع اصول اخلاقي حرفه‌اي در مواجهه با مددجويان پيروي مي‌كنند كه از زاويه سلوك اخلاقي در جرم‌شناسي قابل توجه است.

The entry of social workers into the criminal justice system started based on the doctrines of clinical criminology and in order to actualize the idea of reforming, treating and rehabilitating the delinquents in prisons and rehabilitation centers in such a way that different legal systems have been following the policies of decriminalization and protection of the victims, and social workers are involved in institutions related to the resolution of disputes and restoration of peace and compromise through criminal mediation and have accepted various roles in monitoring the implementation of social penalties and the protection of special victims. The presence of social workers in the criminal justice system of children has a long history, too. Social workers have taken various responsibilities in all areas including special proceedings for children and adolescent delinquents and the protection of vulnerable and victimized children and adolescents. The Iranian criminal justice system, following the approved judicial bills, has been moving towards the assignment of various roles and responsibilities to social workers especially since the recent years. Due to the important duties of social workers in the criminal justice system, this group of professionals follow a kind of professional ethics in dealing with clients, which is significant in criminology from the perspective of ethical conduct.
