Social Rights of Nation and Their Minimal Supply Criteria in Constitution

يكي از نيازهاي اوليه‌ي انسانها امنيت است. «قانون» چتر امنيت براي همه‌ي مردم جامعه است. آشنايي ما با حقوق فردي و اجتماعي، عامل بسيار مهمي براي جلوگيري از تنش‌ها به شمار مي‌رود. تامين حقوق همه جانبه‌ي افراد از زن و مرد و ايجاد امنيت قضايي عادلانه براي همه و تساوي عموم در برابر قانون، به منظور احياء حقوق اجتماعي عامه مردم از مهمترين دستاوردهاي يك قانون جامع و اساسي مي‌باشد تا به پشتوانه آن مردم بتوانند استيفاي حقوق نمايند. از همين رو، در قانون كشورها جايگاه ويژه‌اي براي احقاق حقوق مردم پيش‌بيني شده است. در همين ارتباط ضوابط و معيارهايي نيز در بطن قانون اساسي جمهوري اسلامي ايران به منظور تأمين حقوق افراد جامعه نهادينه شده است كه دولت و حاكميت را موظف به اجراي آن مي‌نمايد. به همين منظور در اين نگاره به بررسي جايگاه حقوق اجتماعي مردم در قانون اساسي و معيارها و ملاك‌هاي تأمين آن از سوي دولت، خواهيم پرداخت. لذا نخست به كليات حقوق افراد و شرايط و پتانسيل تقنيني آن در قانون پرداخته و در نهايت روال كنوني و حالت آرماني تامين حقوق افراد از نگاه قانون، تبيين خواهد شد

One of the primary human needs is security. “Law” is like a security umbrella for all society members. Our familiarity with individual and social rights is considered as a prominent factor in preventing tensions. Of the main achievements of a comprehensive and fundamental constitution, there are ensuring full rights of people whether men or women, creating a fair juridical security for every member, and public equality in law in order to revive the public social rights, so people can achieve their rights accordingly. Thus, a special place is envisaged for realizing human rights in constitution of countries. In this regard, criteria and requirements are institutionalized through constitution of Islamic Republic of Iran secure the rights of society members that enforces the government and regime to execute them. For this purpose, in this research, the status of the people's social rights in constitution and the criteria of their provision by government are reviewed. Therefore, at first, general individual rights and its legal conditions and potentials are reviewed, and then current procedure and the ideal state of supply of people’s rights from the law point of view will be expressed.
