The Political and Legal Issues between Iran and Canada and their Possible Solutions

مسايل سياسي و حقوقي در روابط ايران و كانادا كدامند؟ زمينه‌هاي پيدايش و تداوم اين مسايل چيست؟ آيا راهكاري براي عبور از آنها متصور است؟ هدف مقاله حاضر، بررسي مسايل سياسي و حقوقي مهم در روابط دو كشور و تبيين راهكارهايي براي حل‌وفصل آنها است. مقاله بر اين فرضيه استوار است كه شكل‌گيري مسايل حقوقي بين دو كشور ريشه در مسايل سياسي فيمابين دارد و حل‌وفصل آنها نيز تابعي از رفع مسايل سياسي است. با اين حال، درهم تنيدگي و تاثير و تاثر مسايل سياسي و حقوقي ايران و كانادا مانع از تفكيك كامل آنها از يكديگر و تدارك راه‌حل جداگانه براي هريك از آنها است. بر اين اساس، با واكاوي بستر تاريخي و سياسي روابط ايران و كانادا، سه عامل اساسي در شكل‌گيري مسايل حاد سياسي بين دو كشور شناسايي مي‌شود: آرمان‌گرايي در سياست خارجي دو كشور و پيوند ايديولوژيك آن با سياست داخلي؛ نقش بازيگران ثالث؛ و افراط‌گرايي سياست مداران. مسايل عمده حقوقي بين دو كشور در سطح دوجانبه عبارتند از وضع تحريم‌هاي يكجانبه؛ سلب مصونيت دولتي؛ و احكام قضايي داخلي در كانادا عليه ايران. در سطح بين‌المللي مسايل حقوقي فيمابين شامل تحريم‌هاي بين‌المللي مرتبط با پرونده انرژي هسته‌اي ايران، و مقولاتي نظير حقوق بشر و تروريسم مي‌شود. در نتيجه‌گيري با ترسيم چشم‌اندازي از روابط آتي ايران و كانادا، زمينه‌ها و راهكارهاي عبور از موانع سياسي و حقوقي تحت سه عنوان: بازسازي و برقراري روابط سياسي؛ زمينه‌هاي تعامل اقتصادي و تجاري؛ و زمينه‌هاي تعامل علمي و فرهنگي مورد بررسي قرارمي‌گيرد. روش انجام اين پژوهش توصيفي-تحليلي است و گردآوري اطلاعات با روش جست‌وجوي كتابخانه‌اي و اينترنتي صورت گرفته است.

What are the political and legal issues between Iran and Canada? What are the grounds for their formation and continuation? Are there any solution for them? This paper studies the political and legal issues between Iran and Canada and presents some possible solutions for them. The author hypothesizes that the formation of legal issues between Iran and Canada is rooted in political issues between the two countries and therefore their resolution is also dependent to resolution of political issues. Despite this, the political and legal issues between the two countries are so interwoven that their absolute separation and prescription of distinct solutions for each of them is impossible. Here I explore the political and historical context of the two countries relations and recognize three main factors that have led to formation of sever political issues between the two countries. These three factors are: idealism in the two countries foreign policies and their ideological link to domestic politics, the role third parties have played and finally the politicians’ radicalism. The major legal issues between Iran and Canada at a bilateral level are: imposition of unilateral sanctions, removal of state immunity and Canada’s domestic judicial decisions against Iran. In the international level, the legal issues between Iran and Canada include international sanctions related to the Iranian nuclear energy dossier and issues pertaining to human rights and terrorism. After a thorough explanation of these factors, I have concluded that there are some solutions for the existing problems between Iran and Canada that can be classified as rebuilding and establishment of political relations, improvement of economic and trade interactions, and enhancement of scientific and cultural cooperation.
