چكيده فارسي :
مقاصد شریعت عبارت از اهدافی است كه در شریعت به‌منظور جلب مصالح و دفع مفاسد بندگان، از ناحیۀ شارع دنبال می‌شود. مقاصد شریعت به اعتبار اهمیت، به ضروریات، حاجیات و تحسینات تقسیم شده‌اند كه حفظ دین، جان، عقل، نسل و مال بندگان از مصالح ضروریه تلقی شده است. فقیه به استناد آیات، احادیث معتبر، عقل و بنای عقلا، مشروعیت و موارد مقاصد شریعت را به‌دست می‌دهد. مقاصدی كه در منابع شناسایی شده‌اند، در فهم و تفسیر حكم شرعی مؤثرند و چه بسا، دلیلی كه متضمن مقاصد است، از ظهور اطلاق یا عموم دلیل متضمنِ حكم، جلوگیری كند یا در نفی اعتبار برخی روایات مغایر با مقاصد استفاده شود.
چكيده لاتين :
The purposes of the sharia and its position in the inferred legal ruling Sharia law purposes, concluds the goals in sharia to draw and disposal of harmful and benefits creaturs , is seeking by legislator. Purpose of sharia to validate the importance divided to necessity , Haji , and admiration. The preservation of religion , life, intellect , wealth generation and creaturs property is considered as the essential benefits . Jurisprudent with help the verses , hadiths valid reason and constructions of rationals obtaining legitimacy and purposes to the sharia . Purposes have been identified in resources ,are effected in the understanding and interpretation of legal ruling. Perhaps , the reason is to ensure that objectives can be prevent to apperant of absoluteness and generality of reasons underlying judgment, or deny the authenticity of traditions contrary to the purposes to be used .
