Exploring into Shī‘a Jurisprudential Proofs concerning Conditionality of Puberty in Soundness of Transactions

بلوغ متعاملین در معاملات، از جمله شرایط صحت یا نفوذ معامله در همه نظام‌های حقوقی است. به رغم این‌كه اصل شرطیت بلوغ در معاملات، نزد عقلای عالم پذیرفته شده است، احكام و مقررات آن یكسان و شبیه به یكدیگر نیستند. در مقاله حاضر سعی شده است مفهوم بلوغ و علایم و نشانه‌های آن بررسی شود و این نكته به اثبات برسد كه بلوغِ عنوان شده در فقه، كه شرط صحت معامله است، به دلیل انحصار به مكانیزم جسمانی انسان نمی‌تواند در معاملات، كه از امور عقلی و عرفی است، شرط صحت قلمداد شود.

Puberty of the two parties in transactions is among the preconditions for the soundness or effectuality of transaction in all legal systems. Despite the fact that the principle of conditionality of puberty in transactions is approved by the intellectuals of the world, its rulings and regulations are not one and the same. It is tried in the present article to study the concept of puberty and its signs and to prove that the puberty mentioned in jurisprudence, which is a precondition for the soundness of transactions, due to its exclusiveness to human physical mechanism, cannot be considered as a condition for soundness in transaction, which is among the rational and conventional matters.
