قوانين ناظر بر دادرسي اطفال در حقوق كيفري ايران

Laws on Children's Criminal Prosecution in Iran's Criminal Law

دوران طفوليت، دوران تكوين و شكل گيري شخصيت انسان است. امر خطير سازندگي و تربيت اطفال علاوه بر خانواده بر عهده ي متصديان امور جامعه بوده كه بايد با توجه و ساماندهي به موضوعات اقتصادي، سياسي، فرهنگي، اجتماعي و ساير عوامل در ساختن جامعه ي بهنجار همت گمارند. قوانين خاص اطفال بايد در دادرسي و رسيدگي به جرائم اطفال معارض قانون در صدد واكنش هايي باشند كه در جهت بازسازي شخصيت، اصلاح و تربيت و بازگرداندن آنان به يك زندگي سالم تلاش نمايند. قانون آيين دادرسي كيفري مصوب 1392، داراي نوآوري ها و قوانيني دررابطه با سازمان و تشكيلات قضايي رسيدگي به جرايم اطفال و نوجوانان، نظيردادسرا و دادگاه ها است و همچنين قوانيني نيز به تشريفات رسيدگي به جرايم اطفال و نوجوانان اختصاص يافته است و نهادهاي جديدي نظير مددكاري اجتماعي و پليس ويزه اطفال و نوجوانان نيز در اين قانون پيش بيني شده است. قانون مجازات اسلامي مصوب 1392 نيز داراي قوانيني در رابطه با تدريجي كردن واكنش ها در قبال بزهكاري اطفال و نوجوانان معارض قانون و متناسب سازي آنها با سن ايشان است و در اين ميان تدابير ويژه اي اتخاذ شده است. در اين پژوهش به روش توصيفي- تحليلي سعي در بررسي قوانين ناظر بر دادرسي اطفال در حقوق كيفري ايران خواهيم داشت.

Childhood is a time when human personality is formed and developed. The major task of educating children in the responsibility of not only the families, but also the community administrators, who must endeavor to construct a normal society by considering and organizing the economic, political, cultural, social and other factors. Special laws for children should seek to respond to the prosecution of juvenile offenders in such a way that they can help reconstruct the children's character and educate and restore them to a healthy life. The Code of Criminal Procedure passed in 2013 has innovations and contains laws regarding the judicial organizations such as courts and prosecutors' offices that deal with the crimes committed by children and adolescents, as well as laws concerning the procedure for the investigation of crimes committed by them, and it has predicted new institutions like the Social Work Organization and the specific Police of children and adolescents. The Islamic Penal Code, adopted in 2013, also contains laws on the gradual response to the delinquency of children and adolescents who violate the laws and on the harmonization of punishments with their age, and has taken special measures in this regard. We will try in this descriptive-analytical study to investigate the laws related to children's criminal prosecution in Iran's criminal law.
