قانون مدني در باب وظيفه شوهر حكم صريحي در مورد سكونت در منزل مشترك ندارد، ولي عرف مسلم آن را از لوازم حسن معاشرت با زن مي داند.علاوه بر اين، با توجه به الزام قانون گذار به سكونت در منزل مشترك در دوران عده رجعيه، به نظر مي رسد رويه عملي جاري بين زوجين خلاف اين قاعده است و زوجين پس از اجراي صيغه طلاق از يكديگر جدا شده و به ندرت، موردي پيش مي آيد كه يكجا سكونت نمايند. حتي در نظر عرف عامه سكونت زوجين در منزل مشترك پس از اجراي صيغه طلاق امري مذموم تلقي مي شود و در عمل، امكان اجراي اين حكم وجود ندارد. سوال مورد بحث اين است كه در صورت امتناع يكي از زوجين از سكونت در منزل مشترك، چه در ايام نكاح و چه ايام عده طلاق رجعي،آيا در عمل امكان الزام آن ها به اجراي اين حكم وجود دارد؟ ضمانت اجراي آن چيست؟ در خصوص ماهيت سكونت زوجين در منزل مشترك، گرچه سكونت مشترك مقتضاي اطلاق عقد مي باشد و تراضي خلاف آن امكان پذير است، اما اين سكونت در منزل مشترك به نوعي حق شوهر نيز محسوب مي شود و يكي از لوازم حسن معاشرت است و اسقاط آن به تنهايي ممكن نبوده و بايد با تراضي زوج باشد.
