اصل امنيت حقوقي و مداخلۀ دولت در عرصۀ اقتصاد

The Principle of Legal Certainty and Government Interventions in the Economy

اصل دخالت دولت و لزوم تصميم‌گيري و سياست‌گذاري آن در عرصۀ اقتصاد بديهي به نظر مي‌رسد، اما چنانچه اين مداخله با رعايت موازين و قواعد حقوقي و اقتصادي و با اعمال دقت و ظرافت ويژه صورت نپذيرد، آثار منفي جبران‌ناپذيري در نظام بازار خواهد داشت. يكي از اصول اجرايي در اين‌گونه مداخلات، تأمين اصل امنيت حقوقي فعالان اقتصادي و سرمايه‌گذاران است. اين اصل كه يكي از اصول بنيادين حقوق اداري و اقتصادي است، مبين پيش‌بيني‌پذير بودن و قابل‌ اتكا ‌بودن تصميمات اداري است؛ به گونه‌اي كه شهروندان قادر باشند با اطمينان‌خاطر به نهادهاي دولتي اتكا كرده و براي زندگي خويش برنامه‌ريزي كنند. اين مهم در صورت تحقق مي‌تواند به اعتماد سرمايه‌گذاران و فعالان اقتصادي به دولت و در نهايت افزايش توليد و رونق اقتصادي منجر شود. اركان اصل امنيت حقوقي، انتظار مشروع، عطف به‌ما‌سبق نشدن تصميمات اداري، رعايت مهلت معقول و انتشار و شفافيت مقررات دولتي است. در نظام حقوقي ايران برخي از اين شاخصه‌ها از سوي مقنن يا مراجع قضايي به رسميت شناخته مي‌شوند، اما عملاً در بسياري از موارد اين اصل و اركان آن مهجور و مغفول‌اند. لذا با توجه به تأثير آن‌ها در عرصۀ اقتصاد لازم است بيشتر مورد توجه مقنن، قضات و دولتمردان قرار گيرند.

In my opinion, the necessity of government’s intervention in economy is beyond doubt, but if such intervention become incompatible with the rules, it would cause negative effects on the market system. One of the principles that is needed to be observed in such intervention is the principle of legal certainty. This principle represent predictability and reliability of administrative decisions. So citizens would be able to trust the government institutions and plan for their lives. The Elements of the legal certainty are as follows: legitimate expectation, non- retroactivity of administrative decisions, introducing the law publicly in reasonable and transparency. Some of these indices has been recognized in the Iranian legal system by the legislator or judicial authorities .But in many cases this principle is not being observed. However, due to its impact on the economy it is necessary to pay due attention to this principle.
