مسئوليت بين‌المللي دولت‌هاي ميزبان در قبال خسارات وارده به اتباع بيگانه در قلمروشان با تأكيد بر فاجعۀ منا

The International Responsibility of Host States for Damages to Foreigners in Their Territories with an Emphasis on Mena Catastrophe

فاجعۀ منا از دلخراش‌ترين فاجعه‌هاي انساني جهان اسلام در كنار جنگ يمن و سوريه، دغدغه‌هاي بسياري را در ذهن حقوق‌دانان اسلامي به‌منظور توجه مستقل به ابعاد مختلف آن ايجاد كرده است. در اين بين، مسئوليت بين‌المللي دولت عربستان سعودي واجد اهميت است و مسئوليت بين‌المللي دولت‌ها در قبال خسارات وارده به اتباع بيگانه در قلمروشان مي‌تواند الگوي مناسب براي تحليل اين مسئوليت تلقي شود. با توجه به مبنا قرارگرفتن اصل حداقل رفتار معيار بين‌المللي، رعايت مقتضياتي چون توجه مقتضي، لزوم شفافيت اداري، احترام به انتظارات مشروع بيگانگان و منصفانه و عادلانه‌بودن رفتار دولت ميزبان همراه منطبق‌بودن با موازين بنيادين حقوق بين‌الملل بشر چون حق حيات و احترام به كرامت انساني، نتيجه گرفته مي‌شود كه مسئوليت بين‌المللي دولت عربستان سعودي در فاجعۀ منا به‌ واسطۀ ايفانكردن تعهدات قراردادي بين‌المللي، ارائه‌نكردن اطلاعات دقيق درخصوص قربانيان فاجعۀ منا و بي‌حرمتي به اجساد آن‌ها، تعلل در امدادرساني به حجاج منا و انتقال اجساد قربانيان و تعقيب‌نكردن قضايي متخلفان و مجرمان فاجعۀ منا ايجاد مي‌شود.

Mena Catastrophe is among the deadliest catastrophes in world of Islam. This happening has caused various concerns among Islamic jurists and they intend to probe different aspects of that event impartial. Meanwhile, international responsibility of Saudi Arabia has to be taken into account and the international responsibility of states for damages to foreigners in their territories could play and important role in justification of Saudi Arabia’s responsibility. In the light of the minimum standard of treatment as a criteria , observing minimum factors like due diligence , the necessity of administrative transparency , paying respect to the legitimate expectations of foreigners and fair and equitable treatment of host state alongside with fulfilling fundamental principles of international human rights such as right to life and paying respect to human dignity, we can conclude that Saudi Arabia international responsibility in Mena catastrophe is obvious because of failing to fulfil its international contractual obligations, failing to provide accurate information on the number and identity of victims and desecrating their bodies, failing to transfer remains and failing to conduct judicial prosecution of the Mena catastrophe responsible persons.
