سيطره حبس گرايي و روياي حبس زدايي در سياست كيفري ايران (مطالعه موردي حوزه قضايي شهر كرمان)

Incarceration Hegemony and Decarceration Dream in Iranייs Penal Policy (A Case Study on Jurisdiction of Kerman City)

امروزه سياست كاهش جمعيت كيفري زندانيان يكي از اولويت هاي كشورهاي مختلف دنيا از جمله ايران است. بر اين اساس، پژوهش حاضر با رويكرد اميك و تفسيري و بهره گيري از روش شناسي كيفي گراندد تيوري، به بررسي شرايط و راهبردهاي سياست زندان زدايي پرداخته است. بيست و يك نفر از قضات شهر كرمان، به عنوان مشاركت كننده در اين پژوهش مشاركت كردند. قضات با روش نمونه گيري هدفمند و معيار اشباع نظري انتخاب شدند. داده ها با تكنيك مصاحبه عميق جمع آوري گرديد. در نهايت، تجزيه و تحليل داده هاي به دست آمده، منجر به خلق چهار مقوله و يك مقوله هسته شد. مقولات عبارتند از: راه هموار حبس گرايي، تناقض درون سازماني، اجتماع قوا در قاضي و نواقص تقنيني حبس زا. مقوله هسته نيز عبارت است از: سيطره حبس گرايي در سياست كيفري ايران.

Nowadays the policy of penal population reduction of prisoners is one of the priorities of different countries including Iran. Therefore, this study by using emic approach and Grounded Theory methodology, tried to study the condition and strategies of decarceration policy. Twenty-one judges of Kerman city participated in this study as participant. Judges were selected by purposive sampling and theoretical saturation. Data was collected by in-depth interview technique. Finally, the analysis of the data from interviews resulted in the creation of four main categories and a core category. The main categories are: paved way of incarceration; contradiction within the judicial organization; the concentration of power in the judge; and the legal defects causing imprisonment. The core category is also: incarceration hegemony in Iranʹs penal policy.
