امر قضاء و داوري از جمله مسائل مهم اجتماعي است كه غالباً از ديد تاريخ نويسان پنهان مانده است. در سده هاي ششم و هفتم هجري، ديوان قضاء ساز و كار به نسبت مشخصي به خود گرفت. در اين دوره ما شاهد درگيري خلفاي عباسي با قدرت هاي نو ظهور ديگر و برهم خوردن موازنه قدرت در جهان اسلام بوده كه اين امر بر امر قضاء تاثير مي گذاشت. اين پژوهش توجه اصلي خود را به بررسي ساختار نهاد قضاء در دو سده پاياني حكمراني خلفاي عباسي با محوريت مركز خلافت يعني شهر بغداد قرار داده است. پس از بررسي ساختار نهاد قضاء به ويژگي هاي قاضي و ساز و كار ديوان قضاء و كساني كه در امر دادرسي قاضي را همراهي مي كردند پرداخته شده است و سپس رابطه ي بين نهاد قضاء و تحولات سياسي خلافت عباسيان و تاثير آن بر امر قضاء مورد بررسي قرار مي گيرد. اين پژوهش درصدد است با روش توصيفي – تحليلي و بر مبناي مطالعات كتابخانه اي به بررسي موضوع بپردازد.
