The Statute of Limitations of Actions of Victims of the Use of Chemical Weapons during Iran-Iraq War

مرورزمان مانعي در راه اقامه دعاوي اعم از كيفري و حقوقي است. بسته به اين كه مرورزمان در چه نوع دعاوي مطرح شود، ماهيت و اهداف و آثار و قواعد حاكم بر آن متفاوت خواهد بود. در رابطه با استفاده از سلاح هاي شيميايي و نقض قواعد حاكم بر ممنوعيت استفاده از آن ها، مساله مرورزمان در هردو دسته دعاوي حقوقي و كيفري قابل طرح است. با توجه به گذشت مدت زمان مديدي از اتمام جنگ ايران و عراق، امكان استناد به مرورزمان در دعاوي مربوط به استفاده از سلاح هاي شيميايي طي اين جنگ در دادگاه هاي ملي و بين المللي وجود دارد. باتوجه به اين كه مرورزمان يك اصل كلي حقوق است كه از نظام هاي داخلي وارد حقوق بين الملل شده است، اين مقاله ضمن تبيين اصل مرورزمان در نظام هاي حقوقي داخلي و بين المللي، به اين نتيجه مي رسد كه باتوجه به عدم احقاق حقوق قربانيان سلاح هاي شيميايي جنگ عراق با ايران، هرچند هنوز امكان اقامه دعواي كيفري براي قربانيان وجود دارد، اما اقامه دعاوي حقوقي و مطالبه خسارت مي تواند با مانع مرورزمان برخورد نمايد.

Statute of limitations is an obstacle to sue and prosecute crimes. According to the nature of the actions, nature, purpose, effects and rules governing statute of limitations will be different. In relation to the breach of the rules governing the prohibition of the use of chemical weapons at the time of international conflict, both types of statute of limitations emerge. Considering the passage of time from the end of the Iran-Iraq war, the statute of limitation in cases involving the use of chemicals weapons during the war would be a defense in national and international courts. In this article, through explaining the statute of limitations in national and international legal systems, I conclude that although it is possible to prosecute and punish perpetrators of the use of chemical weapons during Iraq-Iran war before the national courts, statutes of limitations have posed a major obstacle to reparation claims.
