Excellent Principles of “Cape Town Convention on International Interests in Mobile Equipments (2001)” with Regard to Aircraft Finance

تامين مالي هواپيما تحت تاثير خصوصيات ويژه ي هواپيما با چالش هاي حقوقي فراواني در عرصه بين المللي همراه بوده است؛ به گونه اي كه تامين كنندگان مالي همواره با خطر عدم شناسايي اصل يا امتياز حقوق خود از سوي كشور محل اجرا يا عدم اجراي موثر و كاراي آن حقوق نسبت به هواپيما مواجه بوده اند. اولين تلاش بين المللي براي حل مسائل مربوطه در قالب «كنوانسيون ژنو 1948 راجع به شناسايي بين المللي حقوق نسبت به هواپيما» محقق گرديد اما به دليل كاستي هاي بسيار، با استقبال تامين كنندگان مالي همراه نشد. از اين رو، توافق بين المللي ديگري لازم بود تا ضمن رفع كاستي هاي كنوانسيون ژنو، چالش هاي فوق الذكر را به حداقل برساند. اين مهم، پس از گذشت نيم قرن، در «كنوانسيون كيپ تاون 2001 راجع به حقوق بين المللي در تجهيزات متحرك» و پروتكل هواپيماي آن به بهترين شكل به ثمر نشست. غالب صاحب نظران بر اين باورند كه كنوانسيون كيپ تاون شفافيت و قطعيت حقوقي بيشتري در تامين مالي هواپيما ايجاد و كاهش هزينه هاي آن و افزايش دسترسي به سرمايه را در پي دارد. در اين مقاله استدلال شده است كه اين نتيجه ي مطلوب، مرهونِ شش قاعده حقوقي است كه از مفاد كنوانسيون كيپ تاون قابل استنباط بوده و شاكله ي اين سند بين-المللي را تشكيل مي دهد.

Aircraft finance has been followed with various legal challenges in international venue as a result of the aircraft natural characteristics; so that financiers have always faced with risk of non-recognition of thier rights or related privilages or denial of or inefficient exercise of of their remedies in relation to the aircraft by other countries. The first international effort for solving the said problems was realized in Geneva Convention on International Recognition of Rights in Aircraft(1948) but due to its deficiencies did not obtain the financiers’ acceptance. Consequently another deal was necessarry to minimize the above-said challenges further to removal of the Geneva deficiencies. This purpose was realized in Cape Town Convention on International Interests in Mobile Equipments after half of a century in 2001. Experts believe that Cape town Convention has produced more clarity and certainty in aircraft finance and consequently has made increase of its availability and reduction of its expenses. This article has argued that the said results come from six legal principles which are inferrable out of the provision of the Cape town convention and form its fundamentals
