چالش هاي ديوان كيفري بين المللي در پيگيري پرونده رئيس جمهور سودان: از مخالفت اتحاديه آفريقا تا عدم همكاري كشورهاي عضو اتحاديه

Challenges of the International Criminal Court to follow up Sudanese President Case: African unio‎n opposed to non-cooperation of its member states with the Criminal Court

پس از عدم موفقيت شوراي صلح و امنيت اتحاديه آفريقا در تعليق پرونده عمرالبشير از سوي شوراي امنيت، ديوان كيفري بين­ المللي دومين حكم جلب عمرالبشير را صادر مي­كند. ديوان كيفري بين ­المللي به موجب اين حكم از دولت­هاي عضو اساسنامه رُم درخواست مي‌كند كه در دستگيري و تحويل عمرالبشير با ديوان كيفري بين ­المللي همكاري كنند. اتحاديه آفريقا در اين شرايط به تلافي شكست در متوقف ساختن حكم دستگيري عمرالبشير تصميم مي­گيرد؛ حداقل از دولت­ هاي عضو بخواهد كه در دستگيري و تحويل عمرالبشير با ديوان كيفري بين‌المللي همكاري نكنند. اين وضعيت باعث مي­شود كه عمرالبشير بدون هراس از حكم دستگيري به كشورهاي عضو اساسنامه از جمله؛ چاد، كنيا و ... مسافرت كند. از اين رو موضع­گيري دولت­­هاي ميزبان بر اولويت حفظ صلح و ثبات سودان و همين­طور الزام به تبعيت از دستورات اتحاديه آفريقا به لحاظ عضويت در آن اتحاديه، باعث شد تا ديوان كيفري بين ­المللي از تمام ظرفيت­ هاي موجود در اساسنامه براي مقابله با اين وضعيت و اعمال صلاحيت خود در دستگيري عمرالبشير استفاده كند و موضوع را به مجمع دولت­ هاي عضو ديوان و شوراي امنيت سازمان ملل گزارش دهد.

Following the failure of the African unio‎n Peace and Security Council to suspend Bashir's case by the Security Council, the International Criminal Court issued a second arrest warrant for Bashir. International Criminal Court pursuant to the decree of States Parties of the Rome Statute to arrest and hand over Bashir's request that cooperate with the International Criminal Court. African unio‎n on the situation in retaliation for the failure to stop the arrest warrant for Bashir decides At least ask member states to arrest and hand over Bashir not cooperate with the International Criminal Court. This situation makes that Bashir without fear of arrest, the States Parties to the Statute including Chad, Kenya and travel. Position on the priorities of host governments to maintain peace and stability in Sudan and the obligation to comply with the orders of the African unio‎n in terms of membership in the unio‎n, makes the Statute of the International Criminal Court in the capacity to deal with the situation and exercise its jurisdiction to arrest Bashir use and subject to the Assembly of States Parties to the ICC and the UN Security Council report.
