چكيده فارسي :
يكي از تقسيم‌بندي‌هاي مهم مجرمان كه در تعيين نوع واكنش عليه آنان مؤثر است، دسته‌بندي آنها به دو گروه مجرمان متمول، صاحب نفوذ و به تعبيري يقه‌سفيد و گروه ديگر مجرمان ضعيف، فقير و به تعبير ديگر يقه‌آبي است. براي مقابله با بزهكاري دسته نخست كه داراي قدرت و استعداد جرايم خطرناك‌ترند، لازم است تدابير پيشگيرانه ويژه‌اي اتخاذ شود. براي مقابله با اين‌گونه مجرمان، هم به لحاظ ماهوي و هم به لحاظ شكلي نيازمند يك سياست كيفري افتراقي هستيم. اين مقاله به واكنش عليه دسته نخست از نگاه امام علي عليه السلام مي‌پردازد. از ديدگاه ايشان مقابله با بزهكاري يقه‌سفيدها پس از اقدامات ريشه‌اي، اجتماعي، فرهنگي و نظارت كنترل و مراقبت، با جديت، شدت و قاطعيت همراه است. از جمله فوايد اين تقسيم‌بندي كه در بيانات امام علي عليه السلام با تعابيري چون مستكبر و مستضعف، قوي و ضعيف، طبقه حاكم و رعيت، اشراف و طبقه سفلي و مانند اينها بيان شده است اينكه جامعه در فرآيندي فرافكنانه فقط به بزهكاري افراد ضعيف و جرايم كم اهميت نپردازد و بزهكاري يقه‌سفيدها و افراد متنفذ را بدون مسامحه تعقيب كند.
چكيده لاتين :
One of the classifications of criminals, which is of importance in specifying reactions against them, is classifying them into rich people who are of high social status (called white collars) and weak and poor criminals (blue collars). To confront crimes committed by the former ones, who have capability of committing more dangerous crimes, special solutions should be found. To confront such criminals, we need a comparative penal policy, both in terms of form and content. The present article discusses reactions which should be adopted against the former group according to Imām ‘Ali. According to him, after taking fundamental, social, and cultural measures as well as making control and inspection, reactions against crimes committed by white collars should be serious, severe, and decisive.
In Imām Ali’s words, this classification has been made by making uses of terms such as mustakbar and mustad‘af, powerful and weak, the ruling class and peasants, aristocrats and lower social class. One the benefits of such a classification is that not only crimes committed by the weak and nonsignificant crimes but also crimes committed by white collars and those who are of high social status can be prosecuted without negligence.
