بررسي مباني فقهي حقوق سياسي زنان در قانون اساسي جمهوري اسلامي ايران

Studying Women Jurisprudential, Legal, and Political Principles in the Constitution of Islamic Republic of Iran

مشاركت سياسي زنان امري مقبول در جهت كارآمد نمودن نظام اجتماعي و سياسي است. قانون اساسي جمهوري اسلامي ايران بر اساس مباني فقهي نگاهي متفاوت به حقوق طبيعي زنان و حق مشاركت سياسي- اجتماعي آنان داشته، آنها را به رسميت شناخته و قواي حاكم را موظف به بسترسازي مقتضي جهت نيل به آن نموده است. علي رغم وجود بسترهاي قانوني براي مشاركت سياسي زنان، در عمل پاره اي از محدوديت هاي ساختاري بر سر راه اين مشاركت وجود دارد. از آنجا كه مبناي قانون اساسي فتاواي فقهي مي باشد، لذا برداشت هاي فقهي نقش اصلي را دارند. برداشت فقهي رايج، زنان را در موضع حكومت، قضاوت و مرجعيت، از باب ولايت انتصابي متصدي نمي داند اما مي توان با تكيه بر ظرفيت فقه مبتني بر اجتهاد زمان و مكان، جايگاه زن را در باب ولايت انتخابي ارتقا مي دهد

Political cooperation of women is an acceptable issue inimproving the efficiency of socio-political systems. TheConstitution of Islamic Republic of Iran, based on its jurisprudential principles, looks differently at women natural rights and their right of socio-political cooperation. It legitimizes such rights and enforces the governing powers to prepare the necessary foundations for achieving such rights. Despite the presence of legal grounds for women political cooperation, there are a number of structural obstacles on the way of enacting such cooperation. Since the Iranian legal Constitution is based on fatwas issued by religious jurists, jurisprudential interpretations play the key role. The common jurisprudential interpretation does not entitle women to have a key role in states of governance, jurisdiction, religious reference, as well as appointed guardianship. However, through relying on potentials of jurisprudence based on time-space diligence, we can enhance women status concerning elected guardianship.
