Justice in Informing from the Perspective of Jurisprudence

ازآنجاكه در اسلام رعايت عدالت امري مهم و ضروري است، مقاله حاضر بر اين است كه جايگاه عدالت در نگاه اسلام را در حوزۀ اطلاع‌رساني و ارتباطات بررسي نمايد؛ بدين صورت كه جايگاه عدالت در اطلاع‌يابي شهروندان اسلامي از يك طرف و پخش اطلاعات و اخبار گروه‌‌ها‌ي مختلف از شهروندان حكومت اسلامي از طرف ديگر، آيا مطلقاً رواست يا اينكه بايد نسبت به گروه‌ها‌ي مختلف و اطلاعات گوناگون در اطلاع‌يابي و اطلاع‌رساني قائل به تفكيك شويم. نگارنده معتقد است فراهم ساختن امكان اطلاع‌يابي همۀ مردم از اخبار و اطلاعات، عرضه و نشر اين يافته‌ها به‌صورت عمومي و عادلانه رسالت نهادهاي متولي نشر اطلاعات و اخبار محسوب مي‌شود و شرطي ارتكازي و بديهي است كه در فعاليت‌هاي اطلاع‌رساني نزد عقلا پذيرفته شده و همۀ كساني كه با علم به اين مسئله نزد عقلا به فعاليت خبررساني و انتقال پيام وارد و متصدّي اين امر مي‌شوند، شرط مذكور را در ضمن عقد مي‌پذيرند و عمل به آن را بر خويش الزام مي‌نمايند. و نهادهاي متولي نشر و توزيع اطلاعات و اخبار بايد براي كليه افراد، احزاب، گروه‌ها‌ و... كه شهروند دولت اسلامي به حساب مي‌آيند و محروم از بيت‌المال مسلمين نيستند، امكان اينكه بتوانند اخبار و اطلاعات خود را تبيين و به نمايش گذارند، فراهم آورند. مخالفان نظام اسلامي دو دسته هستند: دسته اوّل: گروهي كه اقدام به خشونت و جنگ ضد دولت اسلامي مي‌نمايند كه نمي‌توان عقلاً و شرعاً در اين ظرفيت مهم يعني مخابره اطلاعات و اخبار سهيم دانست امّا گروه‌ها‌يي كه مخالفت آن‌ها‌ صرفاً نظري- فكري است كه در صورت رعايت موازين شرعي و اخلاقي در اين مهم ذي‌حق هستند و سلب آن ظلم به حساب مي‌آيد.

Since observing justice is important and essential in Islam, the present article reviews the status of justice in communication and informing from the perspective Islam. That on the one hand the status of justice in informing of citizens and on the other hand, broadcasting and transmitting news of different groups of citizens of the Islamic state news is permissible thoroughly or it is obligatory to distinguish different groups and various information? The author believes that facilitating the acquisition and dissemination of information to the public fairly is the duty of mass media. This condition is obviously accepted by intellectuals who work on the reporting in the contract and act on their obligation to provide it. Institutions of publishing news for all individuals, parties, etc. who are citizens of the Islamic state who are not banned from public funds, may provide agency and publishing. Opponents of the Islamic regime are two categories: First group: this group proceeded to violence and war against the Islamic state. This group does not share on the potential of reporting news in the Islamic government according to the wisdom and religious. second group: this group are opponents of Islamic government but the opposition is just theoretically and ideologically. This group, if observe the ethical and legal principles is share in the reporting system.
